AN ORDINANCE PROVIDING FOR A BUILDING INSPECTION— DE-
PARTEH;NT, CONSTRUCTION AND EgUIPSV"'ENT OY BUInDIIGS
AND STRUCTURES, AND ELECTRICAL AND PLOWBING INSTALL-
ATION AND INSPECTION.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIR-
ARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1,
SECTION 1. BUILDING .INSPECTION DEPARTMENT --BUILDING IN-
SPECTOR- POWERS AND DUTIES OF ---
The department of the survey and inspection of buildings
shall have charge of the enforcing of all ordinances in force or which
may be hereafter enacted, pertaining to the erection, construction,
alteration, repair or removal of buildings, or the storage of combus-
tibles, and the installation of heating appliances, and electrical
apparatus and wires, and plumbing installation. Said department shall
also perform the duties pertaining to the investigation as to the
cause and origin of fires, and such other duties as may be imposed
upon it by ordinance.
SECTION S. BUILDING INSPECTOR --The chief officer of said
department shall be called the building inspector, who during his
term inspect all buildings ereZted and the wiring and plumbing thereo4
except such buildings as the said building inspoM or may be interested
in either as a contractor or for �hich he furnished and labor or mat-
erial and for such buildings the council shall appoint another in-
Spector to make all of said inspections.
SECTION 3. Nothing in this ordinance shall be takers or
construed to mean that the Chief of the Fire Department shall not have
the power and authority to inspgQ buildings as heretofore provided
by ordinance for fire hazards.
SECTION 4. DUTIES OF BUILDING INSPECTOR. It shall be the
duties of'the building inspextor to issue all permits for the erection
of buildings and structures or the making of repairs; to keep a record
of all transactions of said department; to report all violations of
this ordinance to the City Attorney, that the offender may be pro-
secuted; to enter upon the premises wherein any fire has occured,
if necessary, in order to investigate the origin and cause of sukh
fire; and further, to perform such other duties as are herein required
of him. He shall examine all buildings and structures in the course
of erection, alteration or repair through -out the city, as often: as
practicable, and see that all ordinances in relation thereto are com-
plied with, He shall inspect all public school buildings, public
hall, churches and theatres, and all buildings used for manufacturing
and commercial purposes, hotels and lodging houses, at least once each
year, for the purpose of determining the safety of such buildings, the
facilities for egress in case of fire, the overloading of floors, the
storage of combustibles or other dangerous substance, and shall apply
such remedied as he may be empowered to apply. In the performance of
his duties, the building inspector shall have the power to enter any
building or premises in the City of Cape Girardeau,
SECTION 5. The building inspector shall have full dis-
cretionary power bf declar ng public nuisances, all such "buildings or
structures, or Darts thereof as are evidently or palpably unsafe and
dangerous as to fire, or have became unsafe and dangerous from fire,
decay, or other cause, and institute such steps as may be necessary
for the immediate abatement of any and all such nuisances. He shall
have the power to stop the construction of any building or structure
or the making of any repair, where the same is being done in violation
of the ordinances of.this City.

SECTION d. RECORDS OF THE DEPARTMENT ---The records of the
department shall contain; besides a register of its transactions,'&
report of all violations of the ordinance in the improper construction
of any buildings, or in the unsafe condition of any building, or stra-
eture, either from improper construction or from other causes, with
the location, names of the owners, lessees, occupants, master mechanic,
contractor, and architectinterested in the construction of such build-
ing or its occupancy, and in case of fires a record of the probable
origin thereof. Such record shall be open for inspection and informa-
tion to any official of this city.
SECTION 'i. BUILDING INSPECTOR SHALL REPORT MONTHLY ---The
building inspector shall report monthly to the City Council, a state-
ment of the number of permits issued, the total amount of fees collect-
ed for such permits,'and the total amount of fees collected for build-
ing, electrical and plumbing inspection.
SECTION 8. FEES FOR PERMIT AND INSPECTION ---The applicant
or applicants for building permits shall pay to the building inspector
the following fees: $1.50 for all building permits issued under this
ordinance, and in addition thereto the applicant or applicants shall
pay to the building inspector at the time said permit is issued the
following fees for the inspection of the work governed by the permit:
On the first $1,000.00 valuation the sum of .$1.00, and for each add-
itional $1,000.00 or fraction thereof, the sum of $1.00. In all cases
the fees for the inspection and for the permit must be paid before
the permitd are issued. In all cases when the building inspector has
notified the contractor, owner, or owners in writing of any defective
construction of the work, and ordered the correction thereof, and the
defeat has not been corrected at the time any subsequent inspection is
made, the caxnt5a.ctor shall be required to pay an additional inspection
fee of $1.00. All money reveived by the building inspector for permits,,
shall be paid by him into the office of the City Collector onceMch
month at the time of filing his report, and the fees collected by him
for inspection shall be retained by him as compensation for issuing the
permit and making the inspection of the buildings. The building in-
spector shall receipt the part paying for a permit and inspection as
required by this ordinance, and he shall make a duplicate receipt at
the time and keep same in his office. The minimum charge for any in-
spection shall be $1.00.
SE IOU 9. PERMITS TO BE ISEZED ON APPLICATION" -WHEN --
Permits provided for in the ordinance shall only be issued upon 3e
application of the owners or authorized agents of the owners ofihe
property to be built upon. Every application shall contain an agree-
ment to save the city harmless from all costs and damages which may
acrewr by reason: of use and accupancy of a side -walk, street or public
place and contemplated in this article.
SECTION 10, ADDITION OR REPAiRS--Any work of alteration
or repair made or done for any purpose, in, to or upon any building or
structure, except that of necessary repairs not affecting the con-
struction of the external or party walls, chimneys or stairways of a
building, shall, to the extend of such work or alteration, addition
or repair,, be subject to the regulations of this ordinance.
SECTION 11, BUILDING PERMITS TO BE ISSUED --No wall,
structure or part thereof, shall hereafter be built, enlarged or al-
tered until a sufficient plan and specification in the option of the
building inspector, has been submitted to him showing all points of
construction, dimension and other parts contemplated by this ordin-
ance, together with a statement of the materials to be used and of the
site to be occupied and estimated cost of the X
proposed structure, who shall, if the same be in accordance with the
provisions contained herein, issue a permit for the proposed construct-
ion, giving him permission to erect a building or structure at the
place and of the materials and dimensions mentioned in the application.
Structures hereafter erected without a permit, or not in conformity
with the provisions of this ordinance, shall be removed. All plans
and specifications and estimate of cost submitted to the building ins-
pector shall be kept an file in his office,
ARTICLE 2.
SECTION 1, UNSAFE BUILDINGS --If any building, staging or
other structures or anything attached to or connected Faith any build-
ing or other structure in the City Bfi Cape Girardeau, shall by reason
of its construction or use, or from fire, decay or other cause be re-
ported dangerous or unsafe so that to cause or promote fires, or be re-
ported dangerous ask unsafe as to life or i mb, it shall be the duty
of,the building inspector to inspect such building or structure, and if
in his opinion the same be dangerous and unsafe, he shall immediately
notify the owner, agent, occupant or other party having an interest in
such building or structure to cause the same to be made safe wad secure,
or remove- as may be necessary.
SECTION 2, The person or personawRo notified; as provided
in the preceeding section, shall be allowed until twelve otclock noon,
of the day following the service of such notice, in which to commence
the securing or removal of the sake; and he or they shall :.employ suff-
icient labor to remove br secure the sante as expediously as can be done;
however, that in cases where public safety requires immediate action,
the building inspector shall have the right to enter with such workman
and assistants as may be necessary, and cause the said unsafe structure
to be shored up, taken down or otherwise secured without delay, and a
proper fence or boarding to be put up for the protection of the passers-
by.
SECTION 3, If the owner, agent, occupant of other party
interested in said unsafe structure, having been duly notified,ushall
refuse or neglect to comply with the requirements of said notice; as
provided herein, within the time therein limited, then a careful survey
named in said notice shall he made at once by three disinterested persons,
one to be appointed by the building inspector, one by the owner, occupant
or other interested party, and the third chosen by these two; the report
of such survey shall be reduced to writing, and a copy served upon the
owner, occupant or other interested part, and if theowner, occupant, or
other interested party refuse or neglect to appoint a member of said
board of survey when ..hereunto required, then the survey and report
shall be made by the ]Mayor and the City Engineer, and in case of a dis-
agreement they shall choose a third person,
SECTION 4. Whenever a report of any such curvet' is made,
as aforesaid, and the building or structure shall be declared to be
dangerous and: unsafe and likely to.cause or promote fires or to be
dangerous and unsafe as to life and limb, the building inspector shall
upon continued refusal or neglect of the owner, agent, occupant, or
other person interested, to correct or remove same, report such owner,
agent, occupant, or other person interested to the City Attorney for
immediate prosecution for keeping and maintaining a nuisance. All such
buildings and structures se maintained are hereby declared to be a
nuisance.
SECTION 5, ,any person who shall permit any building of
which he is the owner or agent to remain in an unsafe or dangerous
condition, after notice from the building inspector, as hereinbefore
provided, shall, for each and every day he shall so permit the sane to
remain in such condition, he deemed guilty of a misdemeanor, and upon
conviction thereof, shall be fined in a s=V not less than ten dollars

offense. Upon such trial and conviction the judgement in addition to
the punishment hereinbefore provided, shall be that the structure com-
p'iained of be abated as a nuisance, and the same shall be by the Chief
of Police either taken down or properly secured, and the writ shall
issue upon such judgement directed to the Chief of Police of the City of
Cape Girardeau direeting him forthwith to proceed to abate, take down or
otherwise secure such structure so as to make it safe and secure. All
expenses incurred in the removal of such buildings or additions shall be
by the Chief of Police duly itemized and if the owner or owners of any
such building or addition, or their agent, refuse to pay the cost and
expenses of removing such building or addition it shall be the duty of
the Chief of Police to sell at public auction in the City of Cape Gir-
ardeau, first having given three days public notice of the time and place

SECTICIT 6. If any building in the City of Cape Girardeau
sh&ll appear upon examination by the building inspector, to be dangerous
to life and limb be reason of insufficient thickness of galls, over-
loaded floors, or defective construction for other causes, such building
small be held to be dangerous within the meaning of and subject to all
the provisions of this ordinance and the building inspector, besides
proceeding as hereinbefore provided, shall affix a notice of the danger-
ous character of the structure to a conspicuous place on the exterior
wall of said building. Any person or persons removing such notice so
affixed shall be deemed guilty of a misdemeanor; and u on conviction
thereof, shall be fined not less than twenty dollars (20.00) nor more
than one hundred dollars ($100.00) for each and every offense.
ARTICLE 3`.
SECTION'` 1. .all public buildings, school bi oldings, churches
and theatres, and all parts of every such building shall be designed to
safely carry the loads to be im?Oosed thereon, and shall in all other
respects conform to goad engineering practice.
SECTIOII 2. All flues in residences and business buildings,
hereafter constructed shall be lined with tile and with an outer wall
of an incombustible substance at least four inches in thiclm-ess; provided
that nothing herein shall be construed to mean that smoke stacks shall
be lined with the when substantially built;, and used in connection with
a factory or plant of that character.
SECTION 3. All electric .siring shall be done as is not
provided for by Ordinance #1142, adopting the Hational Electrical Code
passed June 13, 1917.
SECTION 4. All plumbing shall be designed and installed to
conform to good plurnoing practice.
SECT10Y 5. The building inspector shall be the inspector -for
electrical wfir2lIg and plumbing; the same fees and his authority shall
extend to and govern, electrical installation and plumbing as it does in
the construction of buildings and the same penalties provided for in
this ordinance shall apply and are hereby made the penalties for any
violation of ar_y of the provisions of this article.
SECTION 6. Upon conviction for any offense for violation
of azy provision of this ordinance ill Articles One, Two, Three, not other-
wise provided for, the fine shall be not less than five dollars ($5'.00)
nor more than one '_Hundred dollars (=$100.00) for each ar every such offense`.
SECTION 7. Any ordinance or parts of any ordiranee in conflict

with any of the previsions of this ordinance are hereby repealed. This
ordinance shall .be taken and construed together with the ordinance
establishing the fire limits of the City of Cape Girardeau.
SECTION 8. This ordinance shall be in force and take effect
from and after its passage.
