HomeMy WebLinkAboutCommForm.320.03-24-1925COMMISSION FORM ORDINANCE NO. 32o AN ORDINANCE FOR REGULATING THE PLANTING, PRUNING AIZ REMOVING OF TREES AND SHRUBS IN THE STREETS AND PARK 71AYS AND ALLEYS IN THE CITY OF CAPE GIRARDEAU, MISSOURI. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: SECTION 1. All trees or shrubs placed in the streets of the City of Cape Girardeau shall belong to the said City and shall be under the supervision and control of the said City. SECTION 2. It shall be unlawful for any person to plant on any street park way or alley of this city any trees of the following varieties, kinds or names: POPULUS CAROLINENSIS - Carnolina Poplar -, POPULUS DEL- TOIDEA - Cottonwood -, POPULUS NIGRA FASTIGIATA - Lombardy Poplar -, AILANTHUS - Tree of heaven -, ROBINIA PSEUDACIA - Black Locust -, GLEDITSIA - Honey Locust -f MORUS TARTITICA - Russian Mulberry -, NYSSA SYLVATICA - Black Gum Shade trees should bt selected from the Following: ACER PLATANOIDES - Norway Maple -, ACER SACHARUK - Sugar Maple -, ACER RUBRW - Red Maple -, QUERCUS RUBRA - Red Oak -, gUERCUS ALBA - White Oak -, gUERCUS PHELLOS - Willow Oak -, CARPINUS - Hornbeam -, AESCULUS - Horse - Chestnut -, ACER S,A.CCHARINUM - Soft or Silver Maple -, MAGNOLIA ACUMINTA - Cucumber Tree -, HICORIA - Hi&ory -, ACER NEGUNDA - Box Elder -, BETULAS - Birches -, FAGUS AMERICANA - American Beech -, FRAXINUS - Ash -, LIQUIDAiBAR - Sweet Gum -, PLANTANUS - Plane or Sycamore -, TILIA AMERICANA American Elm -, Yellow Poplar. SECTION 3. Any person owning a lot or lots fronting on any street, ex- cept in sections designated as business sections, and wherever such streets are graded to grade established by the City engineer, is. request- ed to plant shade trees in the park way on the street or streets border- ing on said lot, lots, parts of lots or parcels of land, first applying to the proper official for variety to be planted and for instructions regarding the place for such trees. Said owner is further requested to cultivate said trees the first year after setting according to directions to be given by the city officials and to replant at proper seasons any tree that will not survive. SECTION 4. The commissioner in charge of streets and parks shall have prepared a plat of the city showing where trees are to be planted and sections designated as business sections where no trees are needed. Said plat shall show what streets permit mixed plantings or special varities, however, subject to property owners selection as stated below, OWNERS MAY SELECT TREES; On all streets where trees are planted at present - except entife blocks without trees - the owners may choose the variety of tree wanted except such as are forbidden to be planted as shade trees. Wherever entire blocks are without trees and streets not now planted, in order to secure,,-" try one variety should be planted on each street and the owners by petition may select whatever variety is desired, provided that bona fide property owners representing over fifty percent of the distance to be planted are signers to said petition. SECTION 5. A1l.Limbs and branches along streets must be removed to a reasonable height and all pruning shall be done under the direction of the commissioner in charge of streets and parks. Any person failing to prune or trim trees when so notified or refusing to execute the work in accordance with instructions from the official in charge shall be liable to the city for the cost of said work, after 30 days notice has been given and the city then shall order said work done at the expense of the abut- ting property owner;; SECTION 6. Any dead trees or stumps along any street or highway within the City limits shall be removed by the property owner, and any not so removed after ten days notice requesting such removal, the city shall remove the same at the expense of the property owner. SECTION 7. The City connissioners shall have power to adopt rules, regulations and specifications and enforce the same in order to carry into effect the provisions of this ordinance. SECTION 8. Any person violating any of the provisions of this ordi- nance shall on conviction be fined in any sum not exceeding $10.00 in addition th charge mentioned. SECTION 9,t Any ordinance or parts of ordinance in conflict herewith are hereby repealed. SECTION 10. This ordinance shall be in full force and effect from and after its passage and approval, r.
