SECTION le That Commission Form Ordinance No® 1312, passed and approved
on the 25th day of .April, 1951, entitled HA_N ORDINANCE PROVIDING FOR THE

SOUTH FORT STS a ff TO TF SOUTH LINE OF ELFT STREET P -ND SOUTH FORT STREET
FROM THE, EAST GUTTER LINE OF 1A E,ST FORT STF�,ET TO THE EAST LINE OF STURDIVANT
STREET AND PROVIDING FOR THE ISSUANCE. OF SPECIAL TAX BILLS IN THE PAY1%MNT
OF THE' COSI OF MIKE111I be and the same is hereby repealed.
SECTION 2® That the portion of West Fort Street, from the south curb line
of South Fort Street to the south line of Elm Street, and the portion of
South Fort Street from the east gutter line of West Fort Street to the east
line of Sturdivant Street, the same being in District No® 4; in the City of �
Cape Girardeau, Missouri, as laid out and designated by Co2m2iSSion Form
Ordinance No® 800, passed and approved on the 23rd day of July, 1937, and
Comes fission Form. Ordinance. No. 1253, passed and approved on the 29th day of
slay, 1950, shall be repaired and resurfaced in accordance with said Coriur ss -
ion Form. Ordinance Nos. 800 and 1253, as Project No. 3`L, in said District
No. 4m
SECTION 3. That the following work shall be done: Prepare the existing
gravel base as required and place thereon an asphalt surface knouts as
t$mixed-in-placer= _type having a thickness of not less than one and one-
half ( 1-1%2) inches between the ex sting gutters of said streets®
SECTION 4. Said repairing and resurfacing of sash streets shall be done by
the Department of Public Works of the City- of Cape Girardeau, Missouri,
under the direction and supervision of the City Engineer, so that the cost
of such repairing and resurfacing shall not exceed an amount equal to
sixty (50) cents per front foot of property fronting and abutting on said
portion of said streets so improved.
SECTION 5. That an accurate account shall be kept of the cost of the work
by the City Engineer, including payment at contract prices for any portions
thereof done by contract, and such cost shall be defrayed by a special tax-
to
axto be assessed in favor of the City of Cape Girardeau, I issouri , against
the property fronting and abutting on said portion of said streets in the
proportion that the linear feet of each lot or tract fronting and abutting
on said portion of said street bears to the total number of linear feet of
all the properteT fronting and abutting on twat portion of said street so
reoaired and resurfaced®
SECTION Q. Upon the completion of said work the said City Engineer shall
report to the council the total cost of said repairg and resurfacing of
said portion of said street, the total number of linear feet of property
fronting and abutting thereon, and the proportionate share of such total
cost chargeable against each lot, tract, and parcel of land fronting and
abutting on said portion of said street, in accordance with the provisions
of this ordinance®
SECTION 7. Upon the filing of such report by the City Engineer, the City
Council shall examine the same, and if said report be found correct., and the

total cost of said repairing and resurfacing does not exceed 60 cents per
front foot on all of the property fronting and abutting upon said portion
of said street, the Council shall levy and assess a special tax against said
property in accordance with said report. Said tax bills shall be sold for
not less than their face. value, and assigned by the City Clerk to any
purchaser or purchasers thereof.
SECTION 8. All ordinances and parts of ordinances in conflict Vdith the
provisions hereof are hereby repealed.
SECTION 9. This ordinance shall take effect and be in .force frog and
after ten days after its passage and approval.
