AN ORDINANCE INANCE PROVIDING FUR THE REPAIRING AND RESURFACING OF MASON STAT
FROK THE EAST LINE OF FOUNTAIN STREET . T'O THE CONCRETE PAVEMENT AT THE 'v'EST
SIDE OF CHESTNUT STREET AND PROVIDING FOR THE ISSUANCE OF SPECIAL TAX BILLS
IN THE PA NT OF THE COST OF SANE AND REPEALING COMMISSION FORM ORDINANCE
NO 1313 PASSED AND APPROVED ON THE 25TH DAY OF APOIL, 1951.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRA31DEAU1 MISSOURI,
AS FOLLOWS:
SECTION 1. That Commission For Ordinance No. 1313, passed and approved
on the 25th day of April, 1951, entitled "AN ORDINANCE PROVIDING FOR T
REPAIRING AND RESURFACING OF MASON STREET FROM � THE EAS! LINE OF FOUNTAIN
STREET AND PROVIDING FOR THE ISSUANCE OF SPECIAL TAX BILLS IN THE PAEvIEVT
OF THE COST OF SAME" be and the same is hereby repealed.
SECTION 2. That the portion of Mason Street in the City of Cape Girardeau,
}Missouri, from the east line of Fountain Street to the concrete pavement at
the gest side of Chestnut Street, the same being in District No. 1, in the
City of Cape Girardeau, Missouri, as laid out and designated by Commission
Form Ordinance No. 1253, passed and approved on the 29th day of May, 1950,
and Commission Form Ordinance No. 500, passed and approved on the 23rd day
of July, 1937, shall be repaired and resurfaced in accordance with said
Commission Form Ordinance Nos. 800 and 1253, as Project No. 2-54, in said
District No. 1.
SECTION 3. That the following work shall be done: Shape the existing
roadway and add aggregate if found necessary; construct there on a wed
in Place Asphalt Surface, 2 inches in thickness and 20 feet in width with
a seal coat if found necessary.
SECTION 4. That said repairing,and resurfacing of said street shall be
done by the Department of Public borks of the City of Cape Girardeau, Missouri,
under the direction and supervision of the City Engineer, so that the cost of
such work of repairing and resurfacing shall not exceed an amount equal to
sixty (60) cents per front foot of property fronting and abutting on said
portion of said street so improved.
SECTION 5. An accurate account shall be kept by the City Engineer of the
cost of said work, including payment at contract prices for any portions
thereof done by contract, and such cost shall be defrayed by a special tax
to be assessed in favor of the City of Cape Girardeau, Missouri, against
the property fronting and abutting on said portion of said street in the
proportion that the linear feet of each lot or tract fronting and abutting
on said portion of said street bears to the total number of linear feet of
all the property fronting and abutting on that portion of said street so
repaired and resurfaced.
SECTION 6. Upon completion of said work the said City Engineer shall
report to the council the total cost of said repairing and resurfacing of
said portion of said.street, the total number of linear Feet of property
fronting and abutting thereon, and the proportionate share of such total
cost chargeable against each lot, tract, and parcel of land fronting and
abutting on said portion of said street, in accordance with the provisions
of this ordinance.
,SECTION 7. Upon the filing of such report by the City Engineer, the City
Council shall examine the same, and if said report be found correct, and the
total cost of repairing and resurfacing same does not exceed 60 cents per
front foot on all of the property fronting and abutting upon the said portion
of said street, the Council shall levy and assess a special tax against said
property in accordance with said report. Said tax bills shall be sold for
not less than their fade value, and assigned by the City Clerk to any
purchaser or purchasers thereof.
SECTION 8. All ordinances and parts of ordinances in conflict with
the provisions hereof are hereby repealed.
SECTION 9. This ordinance shall take of ect and be in force from and
after ten days after its passage and approval.
