AN ORDINANCE AMENDING COMKISSION FORM ORDINANCE
NO. 566,, PASSER AND APPROVED ON THE 25th DAY OF
APRIL, 1929, BY CHANGING THE ZONING OF A PART
OF OUTLOT FORTY ONE (41) U.S.P. SURVEY 2199, IN
THE CITY OF CAPE GIRARDEAU, MISSOURI, FROM A
CLASS A ONE -FAMILY DISTRICT TO A CLASS I LIGHT
INDUSTRY DISTRICT.
WTHEREAS7 the City Council of the City of Cape Girardeau,
Missouri, has received an application from the owner of the
hereinafter described property requesting that the zoning of the
same be changed from a Class A One -Family District to a Class I
Light Industry District., in an area described as follows:
Beginning at a point on the west side of Louisiana
Avenue, the south line of Merriwether Street
extended, thence running 375 feet west, the south
line of Merriwether Street extended to where it
joins the CApe Girardeau Northern Railway right-
of-way; thence running east along said Cape
Girardeau Northern Railway right-of-way 396 feet
to the west line of Louisiana Avenue; thence south
along the west line of Louisiana Avenue 130 feet
to the place of beginning, being part of Out Lot
Number 1+1 of Survey Number 2199,, except therefrom
all that part of Out Lot Forty-one (1+1), U.S.P.
Survey 2199, in the City of Cape Girardeau,
Missouri, described as follows, to -wit: Start at
a point on the west line of Louisiana Avenue where
it is intersected by the south line of Merriwether
Street extended; thence in a northerly direction
with the west line of Louisiana Avenue, fifty-five
(55) feet for a beginning corner; thence continue
in a northerly direction with the west line of
Louisiana Avenue 175.0 feet, more or less, to the
southeast right-of-way line of the Missouri Pacific
Railroad; thence in a southwesterly direction with
said southeast right-of-way line., 221+.0 feet, more
or less to a point that is 55.0 feet north of the
south line of Merriwether Street extended; thence
in an easterly direction parallel to the south
line of Merriwether Street extended, 211.0 feet, more
or less, to the beginning corner, said land being
bounded on the east by the west line of Louisiana
Avenue., on the northwest by the southeast right-of-
way line of the Missouri Pacific Railroad., and on the
south by a line that is parallel to and 55.0 feet
north of the south line of Merriwether Street extended,

WHEREAS, public notice of such application for such
change was given as provided by Commission Form Ordinance No. 566,
and a public hearing was held by the City Council on November 21,
1955; and

WHEREAS, s ' aid application has.been submitted to the City
Planning and Zoning Commission for its recommendation and report
and said City Planning and Zoning Commission reported and
recommended that said property be rezoned in accordance with said
application, and

WHEREAS, am property owners owning property adjacent or
near to the property included within such proposed change have
protested such change; and
WHEREAS, the City Council finds that it would be to the
best interest of all property owners concerned for said property
to be rezoned from a Class A One -Family District to a Class I
Light Industry Distriet.,'NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE
GIRARDEAU., MISSOURII AS FOLLOWS:
SECTION lt That Section 2 of Commission Form Ordinance
No. 566, passed and approved on the 25th day of April, 1929,
shall be, and the same is hereby, amended to change the boundary
of the present light-AXIAdustry district so as to include therein
the hereinafter described property, which said property is hereby
rezoned from a Class A One -Family District to a Class I Light
Industry Districts to -wit:
Beginning at a point on the west side of Louisiana
Avenue, the south line of Merriwether Street
extended, thence running 375 feet vast, the south
line of Merrivether Stfeet-extended to where it
joins the Cape Girardeau Northern Railway right-
of-way; thence running east along said Cape
Girardeau Northern Railway right-of-way 396 feet
to the west line of Louisiana Avenue; thence south
along the west line of Louisiana Avenue 1.1.0 feet
to the place of beginning, being part of Out Lot
Number 41 of Survey Number 2199, except therefrom
all that part of Out Lot Forty-one (41), U.S.P.
Survey 2199s in the City of Cape Girardeau,
Missouri, described as follows, to -wits Start at
a point on the west line of Louisiana Avenue where
it is intersected by the south line of Herrivether
Street extended; thence in a northerly direction
with the west line of Louisiana Avenues fifty-five
(55) feet for a beginning corner; thence continue
in a northerly direction with the west line of
Louisiana Avenues 75.0 feet, more or less, to the
southeast right-of-way line of the Missouri Pacific
Railroad; thence in a southwesterly direction with
said southeast right-of-way line, 224.0 feet,, more
or less to a point that is 55.0 feet north of the
south line of Merriwether Street extended; thence
in an easterly direction parallel to the south
line of Merriwether Street extended, 211.0 feet, more
or less, to the beginning corner, said land being
bounded .on the east by the west line of Louisiana
Avenue., on the northwest by the southeast right -of
way line of the Missouri Pacific Railroad, and on the
south by a line that is parallel to and 55.0 feet
north of the south line of Merrivether Street extended.

SECTION 2: The City Council hereby finds and declares
that the property described in Section 1 above is at the present
particularly suited for the uses and purposes of a Class I Light
Industry District, and that the changes authorized hereby are
reasonable and in reasonable conformity with the existing use
and value of the immediately surrounding property.
SECTION 3: All ordinances and parts of ordinances in
conflict with the provisions hereof are hereby repealed, but all
other`
provisions of Commission Form Ordinance No. 566 not amended
or repealed hereby shall remain in full force and effect.
SECTION 4: This ordinance shall take effect and be in
force from and after ten (10) days after its passage and approval.
