NO. 566, PASSED AND APPROVED ON THE 25TH DAY OF
APRIL, 1929, BY CHANGING THE ZONING OF A PART OF
LOT 1 OF THE RODNEY 400 ARPEN TRACT IN OUTLOT 86
OF U. S. P. S. NO. 2199, FROM A CLASS I LIGHT
INDUSTRY DISTRICT TO A CLASS J HEAVY INDUSTRY
DISTRICT.
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has received an application from the owner of the
hereinafter described property requesting that the zoning of
the same be changed from a Class I Light Industry District to
a Class j. Heavy industry District, in an area described as
follows:
Begin at the point where the north line of Out
Lot 86 intersects the east right-of-way line of U. S.
Route 61; thence S. 100 371 U., with the east right-
of-way line of said U. S. Route 61, 746.3 feet; thence
S. 20 OV W., with said east right-of-way line, 21.7
-feet; thence S. 850 531 A., 240.0 feet; thence S. 20
071 W., 43.0 feet, more or less, to the southern
corporate limits of the City of Cape Girardeau,
Missouri; thence S. 830 421 E., with said southern
corporate limits line, 632.0 feet, more or less,
to the east line of said Out Lot 86; thence N. 60
WE., with the east line of said Out Lot 86, 800.0
feet to the northeast corner of said Out Lot 86;
thence S. 830 421 E., with the south line of Lot 1
of the Rodney 400-arpen Tract, to the west bank of
Cape LaCroix Creek; thence in a general northerly
direction with the west bank of said creek, following
the meanders thereof, to the southeast line of the
Bloomfield Road; thence in a southwesterly direction
with the southeast lino of said Bloomfield Road to
a point from which the point where the southeast
line of Bloomfield Road intersects the east right-
of-way line of U. S. RoUte 61 bears S. 450 401 %�
209.0 feet; thence S. 100 371 W., parallel to the
east right-of-way line of said U. S. Route 61,
630.0 feet; thence N. 790 231 W. 110.0 feet to the
east right-of-way line of said U. S. Route 61;
thence S. 100 371 W., with said east right-of-way
line, 896.0 feet; thence S. 790 231 E., with an
offset in said east right-of-way line, 30.0 feet;
thence S. 100 371 W., with said east right-of-way
line, 273.0 feet to the point of beginning.
and
WHEREAS, public notice of such application for such
change was given as provided by Commission Form Ordinance No. 566,
and a public hearing was held by the City Council on February
1956; and
WHEREAS, said application has been submitted to the City
Planning and Zoning Commission for its recommendation and report
and said City Planning and Zoning Commission reported and
recommended that said property be rezoned in aceordance with
said application; and

WHER-EAS, certain property owners owning property adjacent
or near to the property included within such proposed change have
protested such change; and

WIMIM-EAS., the City Council finds that it would be to the
best interest of all property owners concerned for said property
to be rezoned from a Class I Light industry District to a
Class i Heavy Industry District., NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE
GIRARDEAU,, MISSOURI, AS FOLLOWS:
SECTION 1. That Section 2 of Commission Form Ordinance
No. 566, passed and approved on the 25th day of April, 1929,
shall be, and the same is hereby., amended to change the boundary
of the present heavy industry district so as to in -elude therein
the hereinafter described property, which said property is
hereby rezoned from a Class I Light Industry District to a
Class J Heavy Industry District, to -wit:
Begin at the point where the north line of Out
Lot 86 intersects the east right-of-way line of U. S.
Route 61; thence S. 100 371 V., with the east right-
of-way line of said U. S. Route 61,, 746.3 feet; thence
S. 20 071 W., with said east right-of-way line, 21.7
feet; thence S. 850 531 -E., 240.0 feet; thence S. 20
07t V., 43.0 feet, more or less, to the southern
corporate limits of the City of Cape Girardeau.,
Missouri; thence S. 831 L21 'E®, with said southern
corporate limits line, 632.0 feet, more or less.,
to the east line of said Out Lot 86; thence N. 60
061 v,., with the east line of said Out Lot 86, 800.0
feet to the northeast corner of said Out Lot 86;
thence S. 830 42''E... with the south line of Lot 1
of the Rodney 400-arDen Tract,, to the west- bank of
Cape LaCroix Creek; thence in a general northerly
direction with the west bank of said creek., following
the meanders thereof, to the southeast line of the
Bloomfield Road; thence in a southwesterly direction
with the southeast line of said Bloomfield Road to
a point from which the point where the southeast

line of Bloomfield Road intersects the east right-
of-way line of U. S. Route 61 bears S. 450 Lot
209.0 feet; thence S. 100 371 W., parallel to the
east right-of-way line of said U. S. R-caute 61.,
630.0 feet; thence N. 790 23t W. 110.0 feet to the
east right-of-way line of said U. S. Route 61;
thence S. 100 37t W., with said east right-of-way
line, 896.0 feet; thence S. 790 231 E., with an
offset in said east right-of-way line, 30.0 feet;
thence S. 100 371 W., with said east right-of-way
line, 273.0 feet to the point of beginning.
S-ECTION 2. The City Council hereby finds and declares
that the property described in Section 1 above is at the present
particularly suited for the uses and purposes of a Class J
Heavy Industry District, and that the changes authorized hereby
are reasonable and in reasonable conformity with the existing
use and value of the immediately surrounding property.

SECTION 3. All ordinances and parts of ordinances in
conflict with the provision hereof are hereby repealed, but
all other provisions of Commission Form Ordinance No. 566 not
amended or re -pealed hereby shall remain in full force and
effect.
SECTION 4. This ordinance shall take effect and be in
force from and after ten (10N1 days after its passage and approval-.
