SECTION 1. That the portion of Olive Street
in the City of Cape Girardeau, I issouri, frori the existing asphalt pavement
at iiiddle Street to the existing concrete and asphalt pavement at the west
side of Fountain Street,
the sane being in District iJ # 1 , L -i the City of Cape Girardeau, Ki.ssouri, as
laid out and designated by Co1_u_Lission Foria Ordinance No. 800, passed and
approved on the 23rd da -,r of July, 1937, and Cor_�1-_iission ori_ Ordinance No. 1616,
passed and approved on the 20th day of June, 1955, shall be repaired and re-
surfaced in accordance tvrith said Coru:dssion Form Ordinances 11o. 800 and 1616,
as Project No. 1-57 , in said District No. 1
SECTION 2. The following work shall be done:
Grade and shape the existing roadway and gravel surfacing, .place crushed
stone for base grid construct a penetration asphalt, bituminous mat or asphaltic
concrete surfacing, approximately 2 inches thick and 16 to 20 feet in width.
SECTION 3.. Said repairing and resurfacing of said Street shall be clone by the
Department of Public Zlorks of the City of Cape Giraa?deau, Missouri, under the
direction and supervision of the City Enr-ineer, so that the cost of such repair

and resurfacing; shall_ not e._ceed an a_iount equal to silty (60) cents per
front foot of property fronting and abutting on said portion of said street
so improved.
SECTION 4. im accurate account shall be kept by the City :ingineer of the cost
of said work, including payment at contract -prices of any portions thereof done
by contract, and such cost shall be defra- d by a special tax to be assessed in
favor of the City of Cape C-irardeau, liissouri, against the property fronting and
abutting on said portion of said street in the proportion that the linear feet
of each lot or tract fronting and abutting on said portion of said street bears
to the total nui-iber of linear feet of all the :property fronting and abutting on
that portion of said street so re,)aired and resurfaced.
SECTION 5. Upoi} the cor_n,letion of said work the City,-'Jizgineer shall report to
the Cotuicil the total cost of said repairing and resurfacin7 of said street, the
total nu:-iber of linear feet of -oropertyr fronting and abutting thereon, and the
proportionate share of such total cost cliargeable a;-ainst each lot, tract and
parcel of land fronting and abutting on sal -C, -iortion o said street, in accord-
ance with the provisions of this ordinance.
S:ICTION 6. Upon the Min- of such re -- ort by the City Engineer, the City
Council shall examine the sane, and if said report be found correct, mad the
total cost of said repairing and resurfacing does not exceed 60 cents per front
foot on all of the pr- o-)erty fronting and abutting upon the said portion of said
street, the Council shall levy and as-sess a special to -, agc.inst said propert-y in
accordance with said report. Said tw,, bills shall- be sold for not less than
their face value, and assignee' by the Cit77 Cleric to any purchaser or purchasers
thereof.
SECTION 7. All ordinances o_ parts of ordii-lances in conflict with the ..provisions
hereof are hereby relaealed.
SECTION 8. This ordinance shall take
days after its passage and approval.
