AN ORDINANCE ESTAPLISHING THE BOUNDARIES OF SEfa1ER DISTRICT NO. 13 B, A SUBDIVISION
OF SMTR DISTRICT NO. 13, IN THE CITY OF CAPE GIP,ARDEAU, KSSCURI, APPROVING AND ADOPTING
PLAYS FOR THE CONSTRUCTION OF SANITARY SEWERS IN SAID DISTRICT, AUTHORIZING THE OTATIERS OF
LAND ENL'RACED TN SAID DISTRICT TO PROCEED WITH THE CONSTRUCTION OF SAID SERVERS SUBJECT TO
CERTAIN C010ITIONS AND SETTING OUT THE �JETHOD AND REQUIREI-'T;NTS FOR SAID CONST_V.UCTION AND
Ri =JiT OF SAME.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY CF CAPE GIRARDEAU, MISSOURI, AS
FOLLMIS :
SECTION 1. That the following described line shall be the boundary for Sewer District
No. 13 B, a subdivision of Sewer District No. 13, in the City of Cape Girardeau, ?Missouri,
as said Sewer District No. 13 has been established by Commission Form Ordinance No. 1942,
passed and approved on the 25th day of August, 1955:
Begin at the northwest corner of Lot 1, Block 1, Brink's Subdivision; thence south
along the west line of Block 1, Brink's Subdivision, and its continuation with the west
line of the Brinkopf tract, to a point which is 350 feet south of the south line of Block
1, Drink's Subdivision; thence east parallel to the south line of Brink's Subdivision to
a point which is 60.7 feet east of the east line of Albert Street, as said street exists
in Brink's Subdivision, extended south; thence north parallel to the extension of the said
east line of Albert Street, to the southeast corner of Lot 1, Block 7, Brink's Subdivision.;
thence east along the south line of Lots 2 and 3, Block 7, Brinkfs Subdivision, 110 feet to
the southeast corner of said Lot 3; thence north along the east line of Foot 3, Block 7,
and the east line of Lot 10, Block 2, Brink's Subdivision, to the northeast corner of Lot
10, Block 2; thence west along the north line of lots 10, 11, and 12, Block 2, Brink's
Subdivision to the east line of Albert Street; thence north along the east line of Albert
Street to the center of College Street; thence west along the center of College Street and
the north line of Lot 1, Block 1, Brink's Subdivision, to the point of beginning.
SECTION 2. That the plans for the construction of Sanitary Sewers in Sewer District
No. 13 B, now on file in the office of the City Clerk, and the easements accompanying said
plans, for the construction of said sewers across private property, are hereby approver and
adopted and ordered filed, and the easements ordered recorded in the land records of Cape
Girardeau County, 2Missouri.
SECTION 3. That the owners of property in Sewer District No. 13 B are hereby
authorized to proceed with the constriction of said sewers subject to the following
conditions:
That the owners shall arrange for the construction of said sewer system with a
responsible contractor, who shall furnish bond satisfactory to the City for the performance
of said work in strict accordance with the plans therefor, and subject to the approval of
the City and to the proper agency of the State of Missouri having jurisdiction over such
construction; that the said contractor shall furnish the City with satisfactory evidence
that the necessary insurance of the various types required by the City, shall be in effect
for the duration of the contract. That the contractor shall agree to pay the prevailing
wages for labor employed in the work, as provided by law and ordinance. That satisfactory
assurance be given the City that payment will be made by the owners to the contractor for
the full amount of the cost of the work upon its completion and acceptance by the City, and
that payment will be made to the City at the completion of the work for the cost of the
engineering and inspection of said work.
SECTION 4. That following the c, -impletion and acceptance of the work by the 6ity and
the State agency aforesaid, the City shall incorporate said sanitary sewers into its
existing sanitary sewer system for future maintenance and operation of sate.
SECTION 5. This ordinance shall take effect and be in full force from and after
the effective date following its passage and approval.
