AN ORDINANCE ADOPTING PLANS AND SPECIFICATIONS FOR THE CONSTRUCTION OF A SYSTEM OF
SANITARY LATERAL SEWERS TO BE USED IN THE DISPOSAL OF SANITARY SEWAGE IN THE; TERRITORY
DEFINED AS SEWER DISTRICT NO. 12 D 2, A SUBDIVISION OF SN ER DISTRICT NO. 12, IN' THE CITY
OF CAPE GIRARDEAU, MISSOURI, PARTICULARLY DESCRIBED IN COMMISSION FORM T DINANCE NO. 1942,
OF THE CITY CF CAPE GIRARDEAII, MISSOURI, PASSED AND APPROVED ON THE 25TH DAY OF AUGUST, 1955,
ESTABLISHING THE BCU NDARIES OF SAID SEWER DISTRICT NO. 12 D 2, GRANTING PERMISSION TO THE
PROPERTY OWNERS Iiv SAID DISTRICT TO PROCEED WITH THE CONSTRUCTION OF SAID SEWERS UNDER THE
SUPER�TISION OF THE CITY ENGINEER, SUBJECT TO CERTAIN CONDITIONS PERTAINING TO THE MAI\1IER. OF
CONSTRUCTION AND THE PAYMENT OF THE COST CF THE WCR K.
BE IT (F DAIINED BY THE COUNCIL OF TIEL CITY CF CAPE GIR.ARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. That the plans and specifications for the construction of a system of
Sanitary Lateral Sewers to be used in the disposal of sanitary sewage in the territory
defined as Sewer District No. 12 D 2, a subdivision of Sewer District No. 12, in the City
of Cape Girardeau, Missouri, particularly described in Commission Form Ordinance No. 1942,
of the City of Cape Girardeau, Missouri, passed and approved on the 25th day of August, 1955,
heretofore submitted, are hereby adopted as the plans and specifications for said system of
sanitary sewers in Sewer District No. 12 D 2, and ordered filed.
SECTION 2. That the boundaries of said Sewer District No. 12 D 2, shall be as follows:
Begin at the intersection of the north line of Outlot 87, in U. S. Private Survey No.
2199, and the south right of way line of Missouri State Route SK, same being also the south
line of Gordonville Road, on the west line of Sewer District No. 12 D 1; thence S. 331 251 W.,
along the said south right of way line 173 feet to the east lire of Edgewood Road; thence
S. 320 221 W., to the west line of Edgewood Road; thence with the south right of way line of
said Route SK, S. 321 221 W., 175.7 feet; thence with said right of way line along a 91 211
curve to the right 110 feet; thence S. 461 061 E., 175 feet; thence N. 42° 441 E., 125 feet;
thence N. 720 071 E., 53.5 feet to the west line of Edgewood Road; thence east to the northwest
corner of Lot 1, Block 2, Edgewood Highlands; thence N. 871 281 E., along the north line of
said Block 2, 100 feet; thence northwardly 100 feet to a point on the south line of Sherri
Lane, which point is N. 871 281 E., 130.2 feet from the east line of Edgewood Road; thence
in a northeast direction to a point on the north line of Sherri Lane, which point is 150 feet
East of the east line of Edgewood Road, measured normal thereto; thence north, parallel to
and 150 feet east of the east line of Edgewood Road to a point which is 150 feet south of the
south right of way line of Route SK, measured perpendicular thereto; thence N. 331 251 E.,
parallel to the south line of Route SK, to the north line of Outlot 87 and the west line of
Sewer District No. 12 D 1; thence west along the west line of Sewer District No. 12 D 1, to
the point of beginning.
SECTION 3. That the Mayor of the City of Cape Girardeau, Missouri, is hereby authorized
to enter into an agreement with the owners of property within said Sewer District No. 12 D 2,
in which the owners may proceed with the construction of said sewers, said agreement to be
subject to the following provisions and conditions:
That the work shall be performed by a responsible contractor to be selected by said
owners who shall furnish a bond in an amount satisfactory to the City of Cape Girardeau,
Missouri, which bond shall guarantee the performance of the work and payment of all costs
in connection therewith; said contractor shall give the City satisfactory evidence that
adequate insurance will be in effect throughout the term of the contract to cover any claims
for any damage to person or property which might arise in connection with the work, and who
shall agree to save harmless the City from any and all claims or for payment of any part of
the work; who shall agree to make payment for wages paid in accordance with the scale adopted
by the City for the type of labor or skills employed on the work; who shall obtain the permit
required by the Missouri State Highway Commission for the construction on its right of way,
and satisfy all requirements of the Missouri State Division of Health and secure its final
approval of the work. The Contractor shall agree to do all work in accordance with the plans
and standard sewer specifications of the City or as otherwise directed by the City Engineer.
SECTION 4. That following the completion and acceptance of the work by the City and
the Missouri State Division of Health, and the approval of the Missouri State Highway
Commission, the owners above referred to shall make full payment to the Contractor for the
cost of the work and pay to the City the cost of engineering and inspection.
SECTION 5. That this ordinance shall take effect and be in full force from and after
the effective date following its passage and appro?71.
