AN ORDINANCE AMENDING ORDINANCE NOo 2373 ESTABLISHING A SEWER
SERVICE CHARGE FOR TEE USE OF SERVICES OF THE SEWAGE SYSTEM
IN THE CITY OF CAPE GIRARDEAU, MISSOURI
WHEREAS, Commission Form Ordinance No. 2373 was passed and
approved .July 1, 1963, prescribing rates for the use of services of the sewage
system in the City of Cape GL_-ardeau and regulations for such system, and
WHEREAS, certain problems have arisen concerning the inade-
quacies of said Ordinance after the usage of the rates and regulations thereunder
for the period of two years, and
WHEREAS,. It is necessary to amend Commission Form Ordinance
No. 2373 to correct the defects and omissions in said Ordinance, NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE
GIRARDEAU, STATE OF MISSOURI, AS FOLLOWS:
Section to Commission Form Ordinance No� 2373 is hereby amended
as follows:
A. Section. 2 of said Ordinance is hereby deleted and there
shall be insei.ted in lieu thereof Section 2 as follows:
T`Section Z. Each user of the public sewage system of the City
of Cape Girardeau, Missouri, is hereby required to pay to said
City quarterly, semi-annually or annually, as a sewer service
charge a sura computed as follows: The water bills for the months
of October, November and December, 1964, and January, February,
March and April, 1965, for each user shall be totaled and same
shall constitute 7112's of the annual service charge. From this
sum, the annual rate shall be calculated as well as the semi-annual
and quarterly rate for the purpose of billing for each user. The
annual sewer service charge shall be one-third of suchaverage
annual water bill for each user. From and after said dates and
from and after July 1st in each year thereafter, the annual, semi-
annual and quarterly charge shall be based in the same manner
on the water bills for the last preceding October, November,
December, January, February, March and April. All previous
bills calculated under the requirements of Commission Form
Ordinance No, 2373 shall remain in full force until this ordinance
is passed and approved. "
B, That portion of LSection 4 is hereby amended by deleting
the word "monthly" in the first sentence in said section and
inserting in lieu thereof t4quarterly".
C. The word "Monthly" in Section 5 of said Ordinance is
hereby deleted and there shall be inserted in lieu thereof
the word `T Quarterly"..

Do Section 7 of said Ordinance is hereby deleted and
there shall be inserted in lieu thereof Section 7, as follows:
"Section 7e An annual statement for sewer service charge
shall be furnished to each user on the first day of July of
each fiscal year. Any user who shall pay his sewer service
charge annually in advance shall receive a discount of 50/0
provided such annual payment is made on or before the
tenth day of July. Any user who shall pay his sewer service
charge semi-annually in advance shall receive a discount
of 2% provided such semi-annual payment is made on or
before the tenth day of July or t'ue tenth day of January.
All users shall have the right to pay all or any portion of
their quarterly, semi-annual or annual statement at any
time. "
E. Section 8 of said Ordinance is hereby deleted and
there shall be inserted in lieu thereof Section 8 and sub-
sections as follows:
"Section 8.s If any bill for the sewer service charge shall
be unpaid after the tenth day following the date of the rendition
of said bill, an additional charge of 10% thereof shall be`
added thereto. All payments made on such delinquencies
shall be applied as follows: The first amount of the pay-
ment shall be applied on the penalties and the balance on
the statement owing by the user. If any bill for sewer
service charge shall be and remain unpaid as long as thirty
days, sewer services to such premises shall be disconnected
and shall not be reconnected until all past due bills for sewer
service are paid in full together with the cut-off charge of
$100. 00. It shall be the duty of the City Clerk to notify the
superintendent of the sewage system of any delinquency in
the payment of sewer service charge bills and said superin-
tendent shall proceed immediately to disconnect the sewage
system to the premises so in arrears.
"Section 8 (A). To all persons who have paid a year in
advance and leave their residence during such year and
move their residence to a different city shall be entitled
to a refund on a pro -rata basis for that portion of the
calendar year in which they do not live in the ,City of Cape
Girardeau, Missouri-

"Section 8 (B)o All persons who establish a new residence
in the City of Cape Girardeau, Missouri and who do not have
a basis for the establishment of a sewer charge shall pay $1, 00
per month on a quarterly,,, semi=annual or annual basis for
residences until an average is established under the provisions
of this amended Ordinance. New commercial businesses shall
be set at a rate established for similar businesses until an
average rate can be determined under the provisions of this
amended ordinance.
"Section. 8 (C)a All delinquencies of twenty-four months or
more duration may be written off the books of the City as a
bad debt and an uncollectible accountR "
Section 2, All other provisions of Commission Form Ordinance
No. 2373 are hereby ratified and affirmed.
Section 3a. This ordinance shall be in full force and shall take effect
ten days from and after its passage and approval.
