AN ORDINANCE ACCEPTING EASEMENT FOR SEWER PURPOSES
FROM PEYTON O. PATRICK AND MARY KATHRYN PATRICK,
AND SIDES CONSTRUCTION CORPORATION
WHEREAS, Peyton O. Patrick and Mary Kathryn Patrick, his wife,
and Sides Construction Corporation, a Missouri Corporation, have executed
easements for sewer pipes dated June 21st, 1965, conveying to the City of
Cape Girardeau, Missouri, portions of Allen's Subdivision in the City of
Cape Girardeau, Missouri, as more fully described hereafter in this Ordinance
and the City desires to accept such easements and have the same recorded,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
Section 1. The City of Cape Girardeau, Missouri, hereby accepts an
easement for sewer purposes dated June 21st, 1965, executed by Peyton O.
Patrick and Mary Kathryn Patrick, his wife, and Sides Construction Corpora-
tion, a Missouri corporation, conveying to the City of Cape Girardeau an
easement for sewer purposes on the following described real estate located
in the City and County of Cape Girardeau, Missouri:
Part of Lot No. 7 of Allen's Subdivision in the City of Cape
Girardeau, Missouri, described as follows: A strip of land 10
feet wide lying 5 feet on each side of the following described
center line: From a point on the North right-of-way line of
U. S. Highway 61, 829. 5 feet from the south line of Outlot 76;
thence North 73° 56' East, 119. 7 feet to the center line of an
existing sewer easement; thence North 34° 7' West along said
center line of such existing sewer easement, 250 feet for the
point of beginning; thence continue North 34° 7' West, 225 feet
and there terminating at a point connecting with the general
southeasterly foundation wall of a building on real estate owned
by Peyton O. Patrick and Mary Kathryn Patrick, his wife.
and it is ordered that said easement be recorded in the Office of the Recorder
of Deeds of Cape Girardeau County, Missouri.
Section 2. The easement hereby conveyed as described in Section 1
hereof is for the purpose of laying sewer pipe.
Section 3, This Ordinance shall be in full force and effect ten days after
its passage and approval.
