Home My WebLink AboutCommForm.2507.06-17-1965COMMISSION FORINT ORDINANCE NO. 250 AN ORDINANCE PROVIDING FOR THE CALLING AND HOLDING OF A SPECIAL ELECTION WITHIN AND FOR THE CITY OF CAPE GIRARDEAU, CAPE GIRARDEAU COUNTY, MISSOURI, FOR THE PURPOSE OF TESTING THE OPINION OF THE QUALIFIED VOTERS OF SAID CITY ON A PROPOSITION TO ORGANIZE SAID CITY UNDER THE PROVISIONS OF SECTIONS 78.430 TO SECTIONS 78. 640, INCLUSIVE, CHAPTER 78, REVISED STATUTES OF MISSOURI, 1959, PROVIDING FOR THE CITY MANAGER FORM OF CITY GOVERNMENT, FIXING THE DATE OF SAID ELECTION, DESIGNATING THE POLLING PLACES, NAMING THE .JUDGES OF SAID ELECTION, PRESCRIBING THE FORM OF BALLOT TO BE USED AT SAID ELECTION, AND THE FORM. OF NOTICE OF SAID ELECTION, AND DIRECTING THE PUBLICATION OF SAID NOTICE WHEREAS, there have been filed with the City Clerk on the 14th day of June, 1965, petitions requesting a special election to determine whether the City of Cape Girardeau, Missouri, shall organize under the City Manager form of city government; and WHEREAS, the Mayor has by proclamation of even date herewith declared said petitions to be sufficient in law, and designating the 20th day of July, 1965, as the date for holding such special election for such purpose; and WHEREAS, under the provisions of Sections 78. 430 to 78. 640, Revised Statutes of Missouri, 1959, it is mandatory that such election be called within sixty (60) days following the filing of such petitions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE GIRARDEAU, STATE OF MISSOURI, AS FOLLOWS: SECTION to That a special election shall be and the same is hereby called and ordered to be held in the City of Cape Girardeau, Cape Girardeau County, Missouri, on Tuesday, July 20, 1965, for the purpose of submitting to the qualified voters of said city a proposition to organize said city under the provisions of Sections 78. 430 to 78.. 640, inclusive, Chapter 78, Revised Statutes of Missouri, 1959, providing for the City Manager form of government. The polls of said election shall be kept open from the hour of six o'clock (6:00) Central Daylight Time (C. D. T.) in the forenoon until the hour of seven o'clock (7:00) Central Daylight Time (C. D. T.) in the afternoon of said day. SECTION 2. Spanish Ward 9 Carpenter's Union Hall, 731 Jefferson Ward 10 Church of the Nazerine (Activity Center, 1225 Merriwether Ward 11 New Central High School, 205 Caruthers Ward 12 May Green School, 1000 Ranney Ward 13 Arena Building Ward 14 St. Andrews Lutheran Church, 2336 Ki.ngsway Drive SECTION 3. There shall be four (4) judges of election at each polling place, who shall receive a compensation for their services the sum. of $10. 00 per day, and who shall act also as clerks of election. That the City Clerk of the City of Cape Girardeau shall be and she is hereby directed to transmit a certified copy of this ordinance to the Board of Registrars of said city, and that said Board of Registrars and the members thereof be, and it and they are hereby requested to proceed with the holding of registration of voters, as in such cases .required by and under Sections 114. 010 to Sections 1140 270, Chapters 114 and 116, Revised Statutes of Missouri, 1959° SECTION 5. That the City Clerk of the City of Cape Girardeau shall be and she hereby is authorized and directed to prepare and cause to be published in the Southeast Missourian, a daily newspaper of general circulation in the City of Cape Girardeau, County of Cape Girardeau, State of Missouri, a notice of said special election in substantially the following form, to -wit: CITY OF CAPE GIRARDEAU MISSOURI NOTICE OF SPECIAL ELECTION Notice is hereby given that a special election will be held in the City of Cape Girardeau, Cape Girardeau County, Missouri, on the 20th day of July, 1965, pursuant to a Pro- clamation of the Mayor issued on the 17th day of June, 1965, and an ordinance passed by the City Council of said city at a meeting held on the 17th day of June, 1965, for the purpose of to st ug the opinion of the qualified voters of said city on a proposition to organize said city under Sections 78. 430 to 78. 640, Chapter 78, Revised Statutes of Missouri, 1959, providing for the City Manager form of city government. Said election will be held on the date aforesaid at the following places in said City of Cape Girardeau: Ward 1 Third Street Methodist Church, 1206 Chestnut Ward 2 First Christian Church, 829 N West End Blvd.. That said election shall be held and conducted and the results thereof canvassed and returned in all respects in accordance with the laws of the State of Missouri, and the Ordinances of the City of Cape Girardeau, Missouri. - Page Five - SECTION 8.
