AN AMENDED ORDINANCE AMENDING CHAPTER 25 OF
THE GENERAL ORDINANCES OF THE CITY OF CAPE
GIRARDEAU BY CHANGING THE ZONING OF PART OF
TRACT 1 OF A SUBDIVISION OF KLAGES HEIRS OF LOTS
5 and 6 of ALLEN's SUBDIVISION OF OUTLOTS 76 and 77,
U. S. Po SURVEY 2199 TO CLASS "F", COMMERCIAL
WHEREAS, the Planning and Zoning Commission has recommended
that all of the property described in Section 1 of this Ordinance should be re-
zoned Class "F", C.omm,ercial, and
WHEREAS, Public notice of such change in zoning was given as
prescribed by Chapter 25 of the General Ordinances of the City of Cape
Girardeau and public hearing was held in conformity with such notice by the
City Council on fie 17th day of May, 1965, and
WHEREAS, Ordinance dated May 24th. 1965 was passed, which
Ordinance was numbered ® 5 extending the Class "F" Commercial Zone
which Ordinance contained an incomplete description and this ordinance is
being passed solely for the purpose of correcting said description,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF
THE CITY OF CAPE GIRARDEAU, AS FOLLOWS:
Section la Chapter 25 of the General Ordinances of the City of
Cape Girardeau, Missouri, is hereby amended to change the boundary of
the present Class "F" district so as .o include the following described property.
Part of Tract No. One (1) of a Subdivision for the Klages
Heirs of Lots 5 and 6 of Allen's Subdivision of Out Lots
76 and 77, U. S. P. Survey No. 2199, in the City of Cape
Girardeau, Missouri, described as follows: Begin at the
intersection of the South lane of Lot 6 of Allen�s Subdivision
and the East right of way line of Highway No. 61, which is
the Southwest corner of Tract No. 1 of a Subdivision for the
Kl ges Heirs; thence North 36# 48" West 269. 0 feet; thence
North 53' 12' East 3950 0 feet to the center line of the Old
Cape Girardeau -Jackson Roads thence South 24' 061 East with
the center line of said road to the South line of Lot 6 of Allem s
Subdivision, which is the South line of Tract No. 1 of a Subdivi-
sion for the Klages Heirs; thence North 83' 381 West with said
East line 360. 0 feet to the beginning corner.

ALSO, All that part of Lot Seven (7) of Allen's Subdivision
of Out Lots 76 and 77, U. S. P. Survey 2199 in the City of
Cape Girardeau, Missouri, described as follows, to -wit:
Commence at the point where the south line of said Out Lot
76 intersects the northeast right-of-way line of U. S. Route
61, from which point the northwest corner of Out Lot 80
of said U. S. P. Survey 2199 bears South 83" 3W East 142 4
feet; thence North 36' 48' West,: with the northeast right-
of-way line of said. U. S. Route 61, 917. 5 feet for a beginning
corner; thence North 7V 01" East 122. 0 feet; thence North
85' 32.' East 118. 5 feet to a corner on the southwest right-
of-way line of the Cape Girardeau -Jackson. Road (now Kings -
way Drive), from which corner the south line of said Out Lot
76 bears South 24* 331 East 865. 6 feet; thence North 24® 33
West 176.4 feet to the south line of 'Tract No. 1 of the Klages
Partition; thence North 83& 38' West with said south line
347. 5 feet to the southwest corner of said Tract No. 1, said
corner being on the northeast right-of-way line of said U. S
Route 61; thence South 36' 481 East with said northeast
right-of-way line 309. 3 feet to the beginning corner.
The City Council be reby finds and declares that the property described in
Section 1 hereof is, at the present time, particularly suitable for the uses
and purposes of Class "F", Commercial District, and that such change
authorized hereby is reasonable and in reasonable conformity with the exist-
ing uses and values of the immediately surrounding property.
Section 2. This ordinance shall be in full force and effect ten
days after its passage and approval.
