COMMISSION FORM ORDINANCE NO.
AN ORDINANCE ACCEPTING EASEMENT FOR SEWER
PURPOSES FROM CHARLOTTE G, BLACK, A SINGLE
PERSON, FRANK CANTRELL AND JULIA CANTRELL,
HUSBAND AND WIFE, AND THOMAS A. LOVINGGOOD
AND NANCY LOVINGGOOD, HUSBAND AND WIFE, AND
CHARLOTTE P. ZIMMERMAN, A SINGLE PERSON
WHEREAS, Charlotte P. Zimmerman, a single person, Charlotte G.
Black, a single person, Frank Cantrell and Julia Cantrell, husband and wife,
and Thomas A. Lovinggood and Nancy Lovinggood, husband and wife, have
executed easements for sewer pipes dated April 5, 1965,/,,Lconveying to the
City of Cape Girardeau, Missouri, portions of Out Lot 71, in U. S. Private
Survey 2199, and part of Sylvan Acres Second Subdivision as more fully
described hereafter in this Ordinance and the City desires to accept such
easements and have the same recorded, NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
Section 1. The City of Cape Girardeau, Missouri, hereby accepts
an easement for sewer purposes dated April , 1965, executed by Charlotte G.
Black, a single person, and Frank Cantrell and Julia Cantrell, husband and wife,
conveying to the City of Cape Girardeau, Missouri, an easement for sewer
purposes on the following described real estate located in the City and County
of Cape Girardeau, Missouri:
Part of Outlot 71, in U. S. Private Survey No. 2199, described
as follows: A strip of land 20 feet wide lying 10 feet on each side
of the following described center line: Start at the S. W. corner
of Lot 17, Sylvan Acres Third Subdivision; thence N 81' 50' W. ,
along the S. line of Lot 17, extended, 20. 7 feet for a point of
beginning; thence S. 38' 52' W. , 431. 9 feet; thence S. 50' 42' W. ,
285 feet; thence S. 3" 02' W. , 382 feet to an existing manhole
numbered 179 on the plans for Sewer District No. 7-B, said plans
being on file in the office of the City Clerk, City of Cape Girardeau,
Missouri.

and it is ordered that said easement be recorded in the Office of the Recorder
of Deeds of Cape Girardeau County, Missouri...
Section 2. The City of Cape Girardeau, Missouri, hereby accepts
an easement for sewer purposes dated April?,. 1965, executed by Charlotte
P. Zimmerman, a single person, conveying to the City of Cape Girardeau,
Missouri; an easement for sewer purposes on the following described real
estate located in the City and County of Cape Girardeau, Missouri:
Part of Lot 13, Sylvan Acres Third Subdivision, being a strip
of land 10 feet wide, lying south of and adjoining the north
line of Lot 130
and it is ordered that said easement be recorded in the Office of the Recorder
of Deeds of Cape Girardeau County, Missouri.
Section 3s The City of Cape Girardeau, Missouri, hereby accepts
an easement for sewer purposes dated April 5, 1965, executed by Thomas Aa
Lovinggood and Nancy Lovinggood, his wife, conveying to the City of Cape
Girardeau, Missouri, an easement for sewer purposes on the following described
real estate located in the City and County of Cape Girardeau, Missouri®
Part of Lot 8, Sylvan Acres Second Subdivision, described as
follows: A strip of land 10 feet wide lying 5 feet on each side of
the following described center line: Start at a point on the center
line of Sylvan Lane at the intersection with the So line of Lot 10,
Sylvan Acres Second Subdivision, extended; thence north along
the center line of Sylvan Lane 196. 9 feet to the beginning of a
curve to the right; thence with the tangent to said curve, same
being the center line of Sylvan Lane extended North, 180 5 feet
for a point of beginning; thence in a N W. direction a distance
of 215 feet and there terminating at a point which is 13 feet north
of the mid -north corner of Lot 8 and 3 feet east of the W. line
of Sylvan Lane.
and it is ordered that said easement be recorded in the Office of the Recorder
of Deeds of Cape Girardeau County, Missouri.

Section 4. The easements hereby conveyed as described in Sections 1,
2 and 3 hereof are for the purpose of laying sewer pipes.
Section 5. This Ordinance shall be in full force and effect ten days
after its passage and approval.
