AN ORDINANCE VACATING PUBLIC ALLEY BETWEEN
WHITELAW AVENUE AND PERRY AVENUE IN BLOCK 1
OF WHITELAW'S SUBDIVISION
WHEREAS, There is no public need for a 16 -foot alley connecting
Whitelaw Avenue and Perry Avenue in Block 1 of Whitelaw's Subdivision;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, AS FOLLOWS:
Section 1, The 16 -foot alley connecting Whitelaw Avenue and Perry
Avenue in Block 1 of Whitelaw's Subdivision, described more fully as follows:
Begin at a point at the southeast corner of Lot 8, Block
1, Whitelaw's Subdivision in the City of Cape Girardeau, Mis-
souri, thence in a general westerly direction along the south
line of Lot 8 and Lot 15 of Block 1 of Whitelaw's Subdivision,
466 feet to a point on the east side of Whitelaw Avenue; thence
in a general southerly direction along the east line of Whitelaw
Avenue 16 feet to a point which is the northwest corner of Lot
14, Block 1, Whitelaw's Subdivision; thence in a general east-
erly direction along the north lines of Lots 14, 13, 12, 11, 10
and 9, Block 1, Whitelaw's Subdivision, 266 feet to a point on
the west side of Perry Avenue, which is also the northeast
corner of Lot 9, Block 1, of Whitelaw's Subdivision; thence in
a general northerly direction along the west line of Perry Ave-
nue 16 feet to the point of beginning,
is hereby vacated.
Section 2. There is hereby retained by the City of Cape Girardeau,
Missouri, any and all easements for sewer or utility purposes under,
through and across the real estate described in Section 1 hereof.
Section 3, The Mayor of the City of Cape Girardeau, Missouri,
is hereby authorized and empowered to execute and deliver to the owner
of property fronting and abutting on the land described in Section 1 of this
ordinance, Quit Claim Deeds to the said lands to the extent that said lands
revert by law to said abutting owners.
Section 4, This ordinance shall be in full force and effect ten
days after its passage and approval.
