AN ORDINANCE VACATING RUBY STREET ALONG THE NORTH
BOUNDARY OF MARBLE CITY HEIGHTS ADDITION
WHEREAS, There is no public need for Ruby Street along the North
boundary of Marble City Heights Addition to the City of Cape Girardeau,
Missouri,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, as follows:
SECTION 1. The Street described more fully as follows:
The 30 feet right of way running East and West, formerly
dedicated as Ruby Street, adjacent to and extending along
the entire North boundary of Marble City Heights Addition
to the City of Cape Girardeau, Missouri, except any and all
easements for sewer and utilities,
is hereby vacated.
SECTION Z. The Mayor of the City of Cape Girardeau, Missouri is
hereby authorized and empowered to execute and deliver to the owner of
property fronting and abutting on the land described in Section 1 of this
Ordinance, Quit, Claim Deeds to the said lands to the extent that said lands
revert by law to the said abutting owners and to record copy of this ordinance.
SECTION 3. This ordinance shall be in full force and effect ten days
after its passage and approval.
