AN ORDINANCE AMENDING CHAP'T'ER 30 .OF THE CODE OF ORDINANCES OF
THE CITY. OF CAPE GIRARDEAU, MISSOURI BY CORRECTING THE LEGAL
DESCRIPTION CONTAINED IN .CITY MANAGER FORM ORDINANCE NO. 396
WHICH CHANGED THE ZONING OF PART OF HARRIS SUBDIVISION AND
PART OF STURDIVANT SUBDIVISION FROM M-1 TO R-4

WHEREAS, The City Planning and Zoning Commission has
recommended that all of the 'property described in Section 1 of
this ordinance .should be rezoned from M-1 Light Industrial
District to R-4 Multiple Dwelling District, and,
WHEREAS, Public notice of such change was given as pre-
scribed in Chapter 30 of the Code of Ordinances of the City of
Cape Girardeau, Missouri, and public hearing was held in conformity
with .such .notice on Wednesday, June 18, 1969, and;
WHEREAS, The Council of the City. of Cape Girardeau, Missouri,
has elected to rezone the property described in Section 1 from
M-1 Dight Industrial District to R-4 Multiple Dwelling District,
and;
WHEREAS, the legal description contained in. City Manager
Form Ordinance No. 396 was erroneous in that .it did not .conform
to the plats and data submitted to the Planning and Zoning
Commission and the City Council and therefore it was not the
intention of the City Council to rezone the land described in
Section 1 of City Manager Form Ordinance No. 396, NOW, THEREFORE;
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. Section One (1) of City. Manager Form Ordinance
No. 396 is hereby repealed in its entirety and the following is
hereby substituted in its place so as to conform with the intent
of the City Council Action on July 2,. 1969. Section One (1)
shall read as follows:
Section 1. Chapter 30 of the Code of Ordinances
of the City of Cape Girardeau, Missouri, is hereby.
amended to change the boundary of the present R-4 Multiple

Dwelling District,.so as to include thea following
described property:
All of the area south .of Themis Street, west
of Clark Avenue,. back of Spring Street .and north
of the railroad tract north of Independence Street,
particularly described as all. of Blocks2 and 3
Harris Subdivision, a subdivision of Lot 8 and 13
and part of Lots 5, 9, and 121 Sturdivant Eubdivision
of Outlots 58, 59, 81 and part of 60 in U. S .P .,
Survey No. 2199.
SECTION 2. This ordinance shall be :in full force and
effect ten (1.0) days after its pas sage and approval.
