AN ORDINANCE ACCEPTING EASEMENT FOR SEWERS IN SEWER DISTRICT NO. 12 -EE -2

MAY, EVERETT GENE PLUNK AND ROSALEE PLUNK, PAUL R. BOARD AND DOLLIE M.
BOARD, GLEN E. FORNKOHL, JIM STROP AND VICTORIA STROP, HAROLD LEE
GERLACH, THOMAS CHARLES JOHNSON AND RUTH ANN JOHNSON, PHENIE THOMAS,
BERNICE DUNLAP, SOUTHEAST MISSOURI LUMBER COMPANY, DONALD RAY AND

WHEREAS, Frank J. Brockmeyer and Mary R. Brockmeyer, J. Hugh
May and Ruth K. May, Everett Gene Plunk and Rosalee Plunk, Paul R.
Board and Dollie M. Board, Glen E. Fornkohl, Jim Strop and Victoria
Strop, Harold Lee Gerlach, Thomas Charles Johnson and Ruth Ann
Johnson, Phenie Thomas, Bernice Dunlap, Southeast Missouri Lumber
Company, Donald Ray and JoAnn Ray, Olive M. Wylie, guardian of
Annie Isabelle Atkinson, James Mungle and Janet Mungle, Alfred G.
Brockmeyer, and Ignatius J. Strecker Bishop of Springfield -Cape
Girardeau, a corporate sole, have executed easements for sewers in
Sewer District No. 12 -EE -2, conveying to the City of Cape Girardeau,
Missouri, land all in the City of Cape Girardeau, Missouri, and
all as more fully described hereinafter in the Ordinance, and the
City desires to accept such easements and have the sane recorded,
NOW, THEREFORE, REIT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. The City of Cape Girardeau, Missouri, hereby
accepts easements for sewers, executed by Frank J. Brockmeyer and
Mary R. Brockmeyer, J. Hugh May and Ruth K. May, Everett Gene Plunk
and Rosalee Plunk, Paul R. Board and Dollie M. Board, Glen E. Fornkohl,
Jim Strop and Victoria Strop, Harold Lee Gerlach, Thomas Charles
Johnson and Ruth Ann Johnson, Phenie Thomas, Bernice Dunlap,
Southeast Missouri Lumber Company, Donald Ray and JoAnn Ray, Olive M.
Wylie, guardian of Annie Isabelle Atkinson, James Mungle and Janet
Mungle, Alfred G. Brockmeyer, and Ignatius J. Strecker Bishop of
Springfield -Cape Girardeau, a corporate sole, conveying to the
City of Cape Girardeau, Missouri easements for sewers in Sewer District
No. 12 -EE -2 on the following described real estate located in the

City and County: of Cape Girardeau, Missouri:
Part of Lot 2, R. L. Wilson's Subdivision of Outlot No. 74,
in U.S.P. Survey No. 2199, described as follows.:
A strip of land 10 feet wide, the center line of said
strip being described as follows.:
Start at a point of the south line of said Lot 2,
N. 86° 05' Fri., 607 feet from the southeast corner of said
lot; thence N. 4° 05' E., 195 feet for a point of beginning;
thence N. 86° 05' W., 228.8 feet to the =Nest line of the
Frank Brockmeyer tract, and there terminating.
Part of Lot 2, R. L. Wilson's Subdivision of Outlot No. 74,
in U.S.P. Survey No. 2199, described as follows:
A strip of land 10 feet wide, the center line of said strip
being described as follows:
Start at a point on the south line of said Lot 2,
N. 86° 05' W., 835.8 feet from the southeast corner of
said Lot 2; thence N. 41 05' E. 195 feet for a point of
beginning; thence N. 86° 05' W., 165 feet and there terminating.
A strip of land 5 feet wide off of the north side of
Lot 19, Block 2, Kimmel's Addition.
A strip of land 5 feet wide off of the north side of
Lot 20, Block 2, Kimmel's Addition.
A strip of land 5 feet wide off of the north side of
Lot 21, Block 2, Kimmel's Addition.
A strip of land 5 feet wide off of the North side of
Lot 22, Block 2, Kimmel's Addition.
A strip of land 5 feet wide off of the north side of
Lot 23, Block 2, Kimmel's Addition.
A strip of land 5 feet wide off of the north side of
Lot 24, Block 2, Kimmel's Addition.
A strip of land 5 feet wide off of the south side of a part of
Lot 2, R. L. Wilson's Subdivision of Outlot No. 74, U.S.P.
Survey No. 2199, as same is described in a deed recorded in
Book 132 at page 578 in the land records of Cape Girardeau
County, Missouri.
A strip of land 5 feet wide off of the South side of a
part of Lot 2, R. L. Wilson's Subdivision of Outlot No. 74,
U.S.P. Survey No. 2199, as same is described in a deed
recorded in Book 223 at page 21 in the land records of
Cape Girardeau County, Missouri.
A strip of land 5 feet wide off of the south side of a
part of Lot 2, R. L. Wilson's Subdivision of Outlot No. 74,
U.S.P. Survey No. 2199, as same is described in a deed
recorded in Book 237 at page 321 in the land records of
Cape Girardeau County, Missouri.
A strip of land 5 feet wide off of the south side of
a part of Lot 2, R. L. Wilson's Subdivision of Outlot No. 74,
U.S.P. Survey No. 2199, as same is described in a deed
recorded in Book 248 at Page 219 in the land records of
Cape Girardeau County, Missouri.

A strip of land 5 feet wide off of the south side of a
part of Lot 2, R. L. Wilson's Subdivision of Outlot No. 74,
U.S.P. Survey No. 2199, as same is described in a deed
recorded in Book 218 at page 525 in the land records of
Cape Girardeau County, Missouri.
A strip of land 5 feet wide off of the West side of
a part of Lot 2, R. L. Wilson's Subdivision of Outlot 74,
as same is described in a deed recorded in Book 255 at
Page 206 in the land records of Cape Girardeau County,
Missouri,
ALSO: A strip of land 5 feet wide off of the south
side of a part of Lot 2, R. L. Wilson's Subdivision of
Outlot No. 74, U.S.P. Survey No. 2199, as same is described
in a deed recorded in Book 255 at page 206 in the land
records of Cape Girardeau County, Missouri.
A strip of land 5 feet wide off of the east side of a
part of Lot 2, R. L. Wilson's Subdivision of Outlot No. 74,
U.S.P. Survey No. 2199, as same is described in a deed
recorded in Book 143 at page 141 in the land records of
Cape Girardeau County, Missouri.
A strip of land 10 feet wide lying in the southwest
corner of St. Mary's Cemetery, same being a part of Lot 2,
R.L. Wilson's Subdivision of Outlot No. 74, U.S.P. Survey
No. 2199, same being described as follows:
Begin at the Southwest corner of said cemetery, from
which point the east line of said Lot 2 bears S. 86°
05' E., 607 feet and the south line of said Lot 2 bears
S. 4° 05' ;,nT., 190 feet; thence N. 4° 05' E., with the
west line of said cemetery 10 feet, thence S. 86° 05' E.,
parallel to the South line of said cemetery 100 feet;
thence S. 4° 05' W., 10 feet to the south line of said
cemetery; thence N. 860 05' W., along the said south
line 100 feet to the point of beginning.
and it is ordered that said easements be recorded in the Office
of the Recorder of Deeds of Cape Girardeau County, Missouri.
SECTION 2. The easements hereby conveyed as described in
Section 1 hereof is for the purpose of enabling the City, its agents,
servants and assigns, to install, lay, erect, construct, maintain,
operate and repair a certain sewer pipe or sewer main which is to
be placed in, on, upon, or across said described property, together
with all the useful, necessary and proper adjuncts, appurtenances,
manholes, and appliances in connection therewith.
SECTION 3. This ordinance shall be in full force and effect
