AN ORDINANCE ACCEPTING EASEMENT -FOR SEWERS. IN -SEWER
D-ISTRICT', NO'.' -9' FROM BERTHA: MERRI= . : . . ' . . . .
WHEREAS, Bertha Merritt (surviving tenant by the entirety in
that Lonnie Merritt has -,succumbed since said parties acquired the
rights into the herea:fte- mentioned property by Deed recorded in
Book 216, Page 669) has executed: an easement for sewers in Seder
District No. 9, conveying to the City of Cape Girardeau, Missouri,,
portions of Lot 14, Block 14 of the Robertson and Gale Addition,
all in. the City of Cape Girardeau, Missouri and all as more fully
described hereinafter in the Ordinance, and the city desires to
accept such easement and have the same recorded.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. The City of Cape Girardeau, Missouri, hereby accepts
an easement for sewers dated July 2, 1969, _executed by Bertha Merritt,
conveying to the City of Cape Girardeau, Missouri an easement for sewers.
in Sewer District No. 9 on the following described real estate
located in the City and County of Cape Girardeau, Missouri:
The =lest 40 feet of Lot 14, Block 14 of the Robertson
and Gale Addition.
and it is ordered that said easement be recorded in the Office of
the Recorder of Deeds of Cape Girardeau County, .Missouri.
SECTION 2. The easement hereby conveyed as described in
Section 1 hereof is for the purpose of enabling the City of
Cape Girardeau, its agents and servants, .and assigns, to install,
lay, erect, construct, maintain, operate and repair a storm sewer
or sewer main or other means found reasonably necessary to convey
surface water which pipe, main or other methods of conveying
said water is to be placed in, on, upon or across said described
property running in a generally Nest to East direction, together
with all the useful, necessary and proper adjuncts and appurtenances
in connection therewith.'.
SECTION 3. This ordinance shall bein full force and

effect ten days after its passage and approval.
