AN ORDINANCE ACCEPTING AN EASEMENT FOR SEWERS IN SEWER DISTRICT
NOS. 6, 11, 12, 13 and 14, FROM JOSEPH W. LEFARTH, FRANK C. LEFARTH
GERTRUDE LEFARTH, MARY C. LEFARTH, AND ELIZABETH LEFARTH, IN THE
CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI
WHEREAS, Joseph W. Lefarth, Frank C. Lefarth, Gertrude
Lefarth, Mary C. Lefarth and Elizabeth Lefarth have executed an easement
for sewers in. Sewer District Nos. 6, 11, 12, 13 and 14, conveying
to the City of Cape Girardeau, Missouri, land all in the City of
Cape Girardeau, Missouri, and all as more fully described hereinafter
in the 'Ordinance, .and the City desires to accept such easement and
have the same recorded,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS_
SECTION 1. The City of Cape Girardeau, Missouri, hereby
accepts an easement for sewers,,executed by Joseph W. Lefarth,
Frank C. Lefarth, Gertrude Lefarth, Mary C. Lefarth, and Elizabeth
Lefarth, conveying to the City of Cape Girardeau, Missouri, an
easement for sewers in Sewer District Nos.6, 11, 12, 13 and 14,
on the following described real estate located in the City and
County of Cape Girardeau, Missouri:
Part of Outlot No. 54 in U.S. Private Survey No, 2199, being
a strip of land 15 feet wide, the center line of said strip
being described as follows:
Start at a point on the East line of the Hamilton -Wilson
Road, which point is 1092.5 feet South of the North line of
Outlot No. 53, in U.S. Private Survey No. 2199; thence N.
36° 37' W.,.40 feet, more or less, ,to a point on the West
line of Hamilton -Wilson Road for a point of beginning; which
point is 12.5 feet South of the center line of an easement
heretofore conveyed for the purpose of constructing a trunk
sanitary sewer for Sewer District No. 6, measured perpendicular
to said center line thence N. 36° 37' W., 18 feet to a point
which is 12.5 feet South of the center line of the afore-
mentioned easement for Sewer District No. 6; thence N. 54°
07' W., parallel to and 12.5 feet South of the center line
of the aforementioned easement for Sewer District No. 6, ,
1575 feet, more or less, to the `_lest line of the LeFarth
Tract, and there terminating,,also,
Part of Outlot No. 53, in U.S. Private Survey No.. 2199, being
a strip of land 15 feet wide, the center line of said strip
being described as follows:
Begin at a point on the East line of Hamilton -Wilson Road,
1092.5 feet South of the North line of Outlot No. 53, said

point Toeing 12.5 feet South of the center line of an easement
heretofore conveyed for the purpose of constructing a trunk
sanitary sewer for Sewer District No. 6, and measured
perpendicular to said center line; thence S. 36 37' E.,.
parallel to and 12.5 feet South of the center line ofsaid
easement for Sewer District No. 6,_667 feet; thence S. 75°
07' E., parallel to and 12.5 feet South of the center line
of said easement for Sewer District No. 6, 510 feet to the
intersection with the existing 36 -inch sewer previously
constructed to the sewage treatment plant of the 'City of
Cape 'Girardeau, Missouri, .and there terminating.
and it is ordered that said easement be recorded in the Office of
the Recorder of Deeds of Cape Girardeau County, Missouri..
SECTION 2. The easement hereby conveyed as described in
Section 1 hereof is for the purpose of enabling the :City, its agents,
servants and assigns, ,to install, lay, erect, ,construct, maintain,,
operate and repair a certain sewer pipe or sewer main which is to be
placed in, on, upon,,or across said described property, together, with
all the useful, necessary and proper adjuncts, appurtenances, manholes,
and appliances in connection therewith.
SECTION 3. This ordinance shall be in full force and effect
ten (10) days after its passage and approval.
