AN ORDINANCE ACCEPTING EASEMENTS FOR SEWERS IN SEWER DISTRICT
NOS. 6, 11, 12, 13 AND 14, FROM KENRICK PROPERTIES, INC., A
CORPORATION; ELMER HEUER AND GENEVA NADINE HEUER, HIS WIFE;
JOSEPH R. BUSS AND LILLIAN KUSS, HIS WIFE; AND FRANCES T. KUSS,
A SINGLE PERSON; IN THE CITY AND COUNTY OF CAPE GIRARDEAU,
STATE OF MISSOURI
WHEREAS, Kenrick Properties, Inc., a Corporation; Elmer
Heuer and Geneva Nadine Heuer, his wife; Joseph R. Kuss and Lillian
Kuss, his wife; and Frances T. Kuss, a single person, have executed
easements for sewers in Seger District Nos. 6,11, 12, 13 and 14,
conveying to the City of Cape Girardeau, Missouri, land all in the
City of Cape Girardeau, Missouri, and all as more fully described
hereinafter in the 'Ordinance, and the City desires to accept such-
easements
ucheasements and have the same recorded,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. The City of Cape Girardeau, Missouri, hereby
accepts easements for sewers, executed by Kenrick Properties,,Inc.,
a Corporation; Elmer Heuer and Geneva Nadine Heuer, his wife;
Joseph R. Kuss and Lillian Kuss, his wife; and Frances T. Kuss,,a
single person; conveying to the City of Cape Girardeau, Missouri,_
easements for sewers in Sewer District Dios. 6,'11, '12, .13 and 14,
on the following described real estate located i_n the City and County
of Cape Girardeau, Missouri:
Part of Outlot Nos. 54,.55 and Rodney 400 Arpen Tract, in
U.S. Private Survey No. 2199, being a strip of land 10 feet
in width, the center line of said strip being described as
follows:
Begin at a point on the East line of what is 'described as
Tract 1, in a deed to Kenrick Properties; Inc., as same is
recorded in Book 263 at Page 325, in the land records of
Cape Gixardeau County, Missouri, said point being S. 7°
45' W., .approximately 304 feet from the North line of Outlot
No. 54, ,and being 12-.5 feet South of the center line of an
easement previously obtained for the construction of a
sanitary trunk line sewer for Sewer District No. 6, and
measured perpendicular to said center line; thence N. 540
07' Tom'., 30.9 feet; thence N. 75° Sol W.,500 feet thence
N. 16° 48' W., 79.8 feet; thence N. 22° 48' W., 1114.2 feet;
thence N. 410 07' E., ,240.7 feet to the intersection with
the center line of the easement for the construction of a
sanitary trunk line sewer for Sewer District No. 6; thence
N.. 87° 29' W., to the West line of Kenrick Properties, Inc.,
and there terminating, also, a strip of land 10 feet wide,
the center line of said strip being described as follows:

Start at the Northwest corner of Outlot No.. 55; thence S.
80 30' TAT., with- the West line of Outlot No. 55, 67 feet to
the center of an easement heretofore obtained for the
construction of a sanitary trunk line sewer for Sewer
District No. 6, above described; thence S.'260 30'. E.,
along the center of said -easement to the vTest line of
Kenrick Properties, lnc., thence S. 8°- 30' gni., 35 feet for
a point of beginning; thence S. 10° E., _to the center of the
existing sanitary trunk line sewer for Sewer District No. 6,
and there terminating.
Part of Outlot No. 87 and 55 in U.S. Private Survey No. '2199,
described as follows:
A strip of land 10 feet wide, lying South and West of, -and
adjoining the South .and Nest line of a 30 -:foot easement
heretofore conveyed to the'City of Cape Girardeau, Missouri,,
for the purpose of constructing a sanitary trunk line sewer
to serve Sewer District No. 6, in said City, the center line
of said strip being described as follows:
Start at a point on the West line of Outlot No. 55, in U.S.
Private Survey No. 2199, same being the East line of Outlet
No. 87, said point being S. 81- 30':Tni., 67 feet from the
Northwest corner of Outlot No. 55, and on the center of a
30 -foot easement heretofore conveyed to the City of Cape
Girardeau, Missouri, _for the construction of a sanitary
trunk line sewer for Sewer District No. 6; thence continue
S. 8° 30'.W., to a point which is 20-feet.South:of the
center line of said 30 -foot easement, measured perpendicular
thereto; thence S. 26° 30' E., 300 feet, more or less, to
a point on the East property line of the ElmerHeuerTract
for a point of beginning; thence N. 261 30'.W.,'parallel to
and 20.feet South of the center line of said -30 -foot
easement, _640 feet, more or less, to a point, ,at which point
the center line of said 30 foot easement assumes a course of
N. 32° 30' E.; thence N. 32°, 30' E., parallel toand20 feet
West of the center line of said 30 -foot easement, -350 feet,
to a point, at which point said 30 -foot easement assumes a
course of N. 80 30' E.; thence N. 8' 30'. E., parallel to and
20 feet West of the center line of said 30 -foot easement to
the South line of Bloomfield Street, _and there terminating.
Part of the Rodney 400 Arpen.Tract 'and part of a tract of land
in outlet Nos. 55, 56 and 87, as said tracts are described in
deeds recorded in Book 189 at Page 23.7, and in Book 219 at Page
652 in the land records of Cape Girardeau County, Missouri,_
described as follows:.
A strip of land 10 feet in width, the center line of said
strip being described as follows:
Start at a point on the West line of Commercial Street, from
which point the North line of Walnut Street bears South 100
37' edest,483.5 feet; thence South 870 29' East, to a point
on the center line of Cape LaCroix Creek for a point of
beginning; thence continue South 87° 29' East,.255 feet,
more or less, to a point which is 'S feet East of the center
line of the existing 21 inch outfall sewer line for Sewer
District No. 6, and there terminating.

Part of Lot 1, Rodney 400. Arpen Tract, in U.S. Private
Survey No. 2199, being a strip of land 10 feet in width,-
the center line of said strip being described as follows:
Start .at a point on the East line of what is described as
Tract 1, in a deed to Kenrick Properties; Inc., as same
is recorded in Book 263 at Page 325, Ln the land records
of Cape Girardeau County, Miasouri, said point being
South 7 45' West, approximately 304 feet from the North
line of Outlot No. 54 and being 12.5 feet South of the
center line of an easement previously obtained for the
construction of a sanitary trunk line sewer for Sewer
District No. 6, and measured perpendicular to said center
line; thence North 54°`07' West, 30.9 feet; thence North
751 50' West, 500.0 feet; thence North 16°- 48' Nest,
79.8 feet; thence North 221 48' West, 220.0 feet to the
South line of Lot 1, Rodney 400, Arpe-n Tract :and the point
of beginning; thence continue North 220 4.8' West, 358.0
feet to the center of Cape LaCroix Creek and on the South
line of the Kenrick Properties,,Inc.;_and there terminating.
All of that portion ofLot1, Rodney 400 Arpen Tract, in
U.S. Private Survey No. 2199, described as follows: ,
A strip of land 40 feet in width, -lying 15 feet on the
North side and 25 feet on the South side of the following
described line:
Begin at a point on the East right-of-way line of U.S.
Route No. 61,485 feet, North 10° 35' East,: from the North
line of Walnut Street; thence South 790123' East, 110 feet;
thence South 871 29' East, to the center of the channel of
Cape LaCroix Creek, _as said creek now exists,,and there
terminating.
and it is ordered that said easements be recorded in the Office of
the Recorder of Deeds of Cape Girardeau County, Missouri.
SECTION 2. The easements hereby conveyed as described in
Section 1 hereof are for the purpose of enabling the City, its agents,
servants and assigns, to install,.lay, erect, construct, maintain,
operate and repair a certain sewer pipe or sewer main which :is to be
placed in, on, upon, _or across said described property, together with
all the useful, necessary and proper adjuncts,' -appurtenances, manholes,
and appliances in connection therewith..
SECTION 3. This ordinance shall be in full force and effect
ten (10) days after its passage and approval.
