AN ORDINANCE GRANTING A SPECIAL USE PERMITTO J. L. WIESER AND
JERRY -WIESER,. FOR PURPOSES. OF CONSTRUCTING, MAINTAINING AND
OPERATING A WAREHOUSE BUILDING TO BE LOCATED ON A PART OF LOT .5,
BLOCK 1, OF TIMBERLANE SUBDIVISION,IN THE CITY AND COUNTY OF
CA.PE GIRARDEAU,�. MISSOURI

WHEREAS,.J. L. Wieser and Jerry Wieser desire to construct
a permanent.wareh6use building for the storage of boats, motors,
campers, trailers, motorcycles., -and supplies for resale; and
WHEREAS, the proposed location of this warehouse building
is Highway 61 North,'. Northwest of Kage Road; and,
V7HjE:1REAS, this warehouse building will be an improvement
to the neighborhood as it is now a vacant lot; and
WHEREAS, the *Zoning Code of the City of Cape Girardeau
requires that a Special Use Permit be granted for such warehouse
building;
NOW, THEREFORE, BE IR ORDAINED BY THE. COUNCIL OF THE- .
CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION .l. The City. Council, having duly considered the
application finds that the granting of the Special Use'Permit will
not substantially increase traffic hazards, congestion, fire hazards
or adversely affect thegeiieral character of the neighborhood or the
general welfa=re of the'community nor will it overtax public
utilities or be in conflict with th&'comprehdnsi:ve'Plan.
SECTION 2. A Special Use Per -mit for the purpose of
.constructing, maintaining and operating a warehouse building in
Cape Girardeau, Missouri, on the following described property:
In the County of Cape Girardeau, State'of Missouri;
1.291 acres, more'or less,.a part of Lot 5, in Block 1,
of Timberlane Subdivision. in. the City of Cape Girardeau
Missouri. Described -as follows: Begin at the Northeast
corner of said Lot 5, on the South right of way line of
Highway 61; thence South 36' West 250.0 feet to the
Northeast corner of tract, a point of beginning; thence
North 540 Wes -t, 225.0 feet to thd'Northwest corner;
thence South. 360 West 275.5 feet to the Southwest corner;
thence South 531 10' East, 30 feet; thence South .70 40'.
East,_206.0.feet to the Southeast corner; thence North
36° East, 212.5 feet to the point of beginning.

is hereby granted to J. L. Wieser and Jerry Wieser, to be
effective ten days after the date of passage and approval of this
Ordinance. The proposed special use must comply with all regulations
set forth in the Zoning Code for the district in which the use is
located except those which have been specifically excepted under
this permit, all other applicable Ordinances of the City of Cape
Girardeau and any special conditions contained in the Special
Use Permit, a copy of which is attached hereto, marked as
"Exhibit A" and incorporated herein by reference. The Mayor is
hereby given the power to execute the Special Use Permit on
behalf of the City of Cape Girardeau, Missouri.
SECTION 3. This ordinance shall be in full force and
effect ten days after its passage and approval.

being by me duly sworn, did say that he is the Mayor of the City
of Cape Girardeau, a Municipal Corporation of the Statex of Missouri,

seal of said City and, that the said instrument was signed and
:pealed in behalf of said City by authority of its City Council
and acknowledged said instrument to be the free act and deed of
said City.
