AN ORDINANCE ACCEPTING A STREET EASEMENTIFROM LUTHER
TACKETT FOR PART OF LOT 1, BLOCK "F",- CA -PAHA GARDENS,
CITY AND. COUNTY11Y OF CAPE GIRARDEAU,. STATE OF MISSOURI.
FOR STREET RIGHT_.OF-WAY TO IMPROVE. AND. CONSTRUCT
STREETS ON CAPAHA TRAIL
WHEREAS, Luther Tackett has executed a Street .
Easement, conveying to the City of 'Cape -Girardeau, Missouri,
partof Lot 1, Block "F", Capaha Gardens, City and County
of Cape Girardedu,.Missouri, as more fully described
hereinafter in this Ordinance,' and the City desires to
accept such'easeme-n-LL- and have the 'same -recorded.
NOW, THEREFORE., BE IT ORDAINED BY THE COUNCIL OF
THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. The City of Cape Girardeau, Missouri,
hereby accepts a Street Easement executed by Luther
Tackett, dated the*23rd day of August,.1971, conveying to
the City of Cape Girardeau, Missouri, the following described
real estate located in the City. and County of Cape Girardeau,
Missouri:
All of the South 6 feet of Lot 1, .except
the West 245 feet of the. *South.6 feet of Lot 1,
Block "F", Capaha Gardens, Cape`,3irardedu,.
Missouri, lying along and adjacent to the North.
side 'of the existing 40 foot wide Capaha Trail,
as said street exists in Capaha Gardens.
SECTION 2. The Street Easement hereby conveyed
as described in Section 1 hereof is for the purpose -of
enabling the City, its agents,- servants- and assigns to
improve and construct streets.onCapaha Trail, in the
City of Cape Girardeau, Missouri.
SECTION 3.* It is ordered by the '.Council of the
City of Cape Girardeau that said Easement be-�redorded by
the City Clerk in the Office'of the Recorder of Deeds of
Cape Girardeau County, Missouri.
SECTION 4. This Ordinance shall be in full force

and effect ten days after its passage and approval.
