WHEREAS, Leonard W. Lowes and Helen J Lowes, his
wife, :nave executed an easement for sewers in Seder District
No.. 12 -EE -3 conveying to'. the City of Cape Girardeau,
Missouri, land all in the City of Cape Girardeau, Missouri,
and all as more fully described hereinafter in the Ordinance,
and the City desires to accept such easement and have the
same recorded,
NOW, THEREFORE, BE .IT ORDAINED BY THE COUNCIL OF
THE CITY.OF CAPE GIRA.RDEAU, MISSOURI., AS FOLLOWS:
SECTION 1. The City of Cape .Girardeau, .Missouri,
hereby accepts.an easement for sewers, executed by Leonard W.
Lowes and Helen: J. Lowes, his wife, conveying to. the City
of Cape Girardeau, Missouri an easement for sewers in
Sewer District No. 12 -EE -3 on the following described
real estate located in the City and County of Cape Girardea:u,.
Missouri:
All of the. 'East .5 feet .of Lot '.5, Block 2,.
Haddock's Subdivision.
All of the North 15 feet of Lot 5, Block 1,
Haddock's Subdivision.
A strip of land 10 .feet wide, lying 5 feet.
either side of the following described center
linea Begin at the intersection of the North
line of Lot 3 extended to the. center of
Haddock Street;thence North .90 44. East,
280.0 feet to manhole No. 2 of Sewer District
12 -EE -.l and there terminating.
and it is ordered: that said easement be :recorded in the
Office of the Recorder of Deeds of Cape Girardeau County,
Missouri.
SECTION 2. The. easement hereby conveyed as
described in Section 1 hereof is for the purpose'of
- 2 -
enabling the City, its agents, servants and assigns, to
install, lay, erect, construct, maintain, operate and
repair a certain sewer pipe or sewer main which is to be
placed in, on, upon, or across said described property,
together with all the useful, necessary and proper
adjuncts, appurtenances, manholes and appliances in
connection therewith.
SECTION 3. This ordinance shall be in full
force and effect ten days after its passage and approval.
