AN ORDINANCE ACCEPTING AN EASEMENT FOR :SEWERS IN SEWER DISTRICT
12NN and 1473 FROM ROBERT 0... HIRSCH AND WINIFRED. R. HIRSCH---; JOSEPH
N. TYGETT AND JOANNA M. TYGETT; JAMES WILLIAM TERRY, JR., AND
NORMA ELOISE TERRY; THOMAS G. TYGETT AND ANITA C. T`IGETT, HUSBANDS
AND WIVES, IN THE CITY AND. COUNTY OF CAPE GIRARDEAU, 'STATE OF
MISSOURI
WHEREAS, Robert O. Hirsch and TATini;fred_R.. Hirsch; Joseph N.
Tygett and Joanna M. Tygett; James William Terry, Jr., and Norma
Eloise Terry; and Thomas G. Tygett and Anita C. Tygett, husbands
and wives, have executed an easement for seders in Sewer District
No. 12NN and 14H conveying to the City of Cape Girardeau, Missouri,
land all in the City of Cape Girardeau, Missouri, and all as more
fully described hereinafter in the Ordinance, and the City desires
to accept such easement and have the same recorded,,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. The City. of Cape Girardeau, Missouri, hereby
accepts an easement for sewers, executed by Robert 0. Hirsch and
Winifred R. Hirsch Joseph N. Tygett and Joanna M. Tygett; James
William Terry, Jr., and Norma Eloise Terry; and Thomas G. Tygett
and Anita C. Tygett, husbands and wives, ,conveying to the City of
Cape Girardeau, Missouri, an easement for sewers in Seater District
No. 12NN and 14H on the following described real estate located
in the City and County of Cape Girardeau, Missouri.
Part of Section 30, T. 31 N., R. 14 E., described
as follows;
A strip of land 10 feet wide, lying 5 feet on either
side of the following described center liner
Begin at a point on the north.line`of Section 30,
40 feet east of the northwest corner of Section 30,
thence south parallel to the west line of Section 30,.
1245.8 feet, more or less,to an intersection with
the existing sanitary outfall sewer serving Sewer
District No. 12®CC, and there terminating.
and it is ordered that said easement be recorded in the Office of
the Recorder of Deeds of Cape Girardeau County, Missouri.

SECTION 2. The easement hereby conveyed as described in
Section 1 hereof is for the purpose of enabling the City, its
agents, servants and assigns, to install, lay, erect, construct,
maintain, operate and repair a certain sewer pipe or sewer main
which is to be Placed in, on, upon, or across said described property,
together with all the useful, necessary and proper adjuncts,
appurtenances, manholes, and appliances in connection therewith..
SECTION 3. This ordinance shall be in full force and effect
ten (10) days after its passage and approval.
