AN ORDINANCE REPEALING CITY. - MANAGER FORM ORDINANCE NO. 608
AND ENACTING IN LIEU THEREOF A NEW ORDINANCE GRANTING A
SPECIAL USE PERMIT TO J. L. WIESER AND JERRY WIESER, FOR
PURPOSES OF CONSTRUCTING, MAINTAINING AND OPERATING A
WAREHOUSE BUILDING TO BE LOCATED ON . A PART. OF LOT 51 BLOCK 1,
OF TIMBERLANE SUBDIVISION,. ; IN .THE CITY AND COUNTY OF CAPE
G I RARDEAU , MISSOURI
WHEREAS, J. L Wieser and Jerry Wies-e-r in accordance
with the. terms of City- Manager Form Ordinance 'No. 608 obtained
a Special Use Permit *.for the 'cons truction of a warehouse
building, .and
WHEREAS, J . L, Wieser and Jerry Wieser desire to expand
warehouse 'f aci litres* -on the. parcel of ground for which *the
special use- was granted, and
WHEREAS,- a question has arisen as to- the -rieces-sity of
clarifying the 'said Special Use- Permit.
NO.W, THEREFORE.,' BE TT ORDAINED. BY; TRE COUNC.I.L 'OF THE
CITY OF CAPE, G IRARDEA-U , . MISSOURI*, AS FOLLOWS.:
SECTION .1. Ci:.ty. Manager. Form Ordinance* No. 608 is
hereby repealed and a new ordinance enacted in lieu thereof
reading as follows.: -
SECTION .2 .* The. 'City- Council, having duly recons i-dered
the application, finds- -that the. -granting of a Special Use
Permit will not substantially increase- .traffic hazards,- congestion,
fire .hazards or adversely affect the general character of the
neighborhood or the general wehf are *of the 'community nor will
it overtax public utilities or be 'in conflict with the
comprehensive plan.
SECTION 3.* A Special Use Permit .for the purpose of
constructing, .maintaining and operating a warehouse building
not to exceed eighty (8.0). feet by ninety --nine (99) feet four (4 )
inches in size in Cape Girardeau, Missouri , on the following
described property.:
In the County of Cape Girardeau, State. 'of Missouri;
1.291 acres',- more or less-,- a part of Lot 5, in Block 1,
of Timbe.r.lane 'Subdivision in the City of Cape Girardeau
Missouri, .des.cribed as follows : Begin at the Northeast
corner of said Lot .5, on the. 'South rightof way line of
Highway 61; thence South 360 West 250 .0 feet to the
Northeast corner of tract,, a point of beginning; thence
North '540 West, .225.0 feet to the Northwest corner;
thence South. 3 6 ° West- -275.5 feet to the 'Southwest corner;
thence South 5 3 ° 10' East, 30 feet thence South 700 401
East, 206-.0 .feet to the Southeast- corner; thence North
36 East,-. 21.2..5 feet to- the. 'point of beginning.
is hereby granted to J. L. Wieser and Jerry Wieser, to be
effective 'ten days after the 'date of passage *and approval of this
Ordinance..The proposed special use must comply with all regulations
set forth In the 'Zoning Code Tor the. district -in which .the 'use is
located except those- which have 'been specifically excepted under
this permit, all other applicable 'Ordinances -of th.e City of Cape
Girardeau and any special conditions contained in the Special
Use Permit, a copy of which Is attached hereto, marked as
"Exhibit A" and incorporated herein by reference The Mayor is
hereby, given the 'power to execute the Special Use Permit on
behalf of the City of Cape Girardeau, Missouri .
SECTION 4. This ordinance 'shall be 'in full force *and
effect ten days after its passage and approval,
