AN ORDINANCE ACCEPTING EASEMENTS FOR SEW_E�RSIN SEWER DISTRICT NO.
6 AND 121N THE CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF
MISSOURI
WHEREAS, Jacob Pollack and Esther S. Pollack, his wife, and
Sydney R. Pollack and Marilyn Pollack, his wife; and R. J. -McKinney

and Milford R. Welker, As Trustees for Jim Wilson Co. Profit
Sharing Trust, have executed easements for sewers in Sewer District
No. 6 and 12, conveying to the City of Cape '.Girardeau,Missouri,
land all in the City of Cape Girardeau, Missouri, and all as more
fully described h6teinafter in the ordinance,* and the City desires
to accept such easements and have the same recorded;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION1. The City of Cape Girardeau, Missouri, hereby
accepts easements for sewers, executed by Jacob Pollack and Esther S.
Pollack, _his. wmfe',,r., and Sydney R. Pollack and Marilyn Pollack, his
wife;. and R. J. McKinney and Milford R. Welker, As Trustees for
Jim Wilson Co. Profit Sharing Trust, conveying to the City of Cape
Girardeau, Missouri, easements for sewers in Sewer District No.
6 and 12 on the following described real estate located in the'Citv
and County of Cape Girardeau, Missouri:
Part of Lot 9, Sturdivant's Subdivision of Outlot
Nos. 58, 59, 81 and Part of 6.0, in U.S.P. Survey No. 2199,
being a strip of land 20 feet wide, lying West of and
adjoining the East line of said Lot 9, 'beginning at the
North line of Independence 'Street and extending to the
South right-of-way line of the Missouri Pacific Railroad
Company
Said right,. privilege, permission and authority to
enter on and upon said 'property above described is .
.granted only upon the condition that when the sewer pipe
or sewer main has been completely installed, the City
.guarantees that the property will be restored to its
same condition prior to the beginning of construction.
Part of Lot 10, Sturdivant's Subdivision-, of
Outlots No,.-, 58, 59,,81 and part of 60, in U.S.P.S.
No. 2199, being a strip of land 20 feet wide lying West
of and adjoining the East line of said Lot 10 and the
East line of Outlot No. 81, extending from the 'South
line 'of Outiot No. 81 to the South line'of Independence
Street, except any part contained within property
described in tract deeded to Burton J. Gerhardt and
recorded in Book 275 at Page 104.
Said right, privilege, permission and authority to
enter on upon said property above described is granted
only upon the condition that when the sewer pipe
or sewer main has been completely installed, the City
guarantees that the property will be restored to its
same condition prior to the beginning of construction.
SECTION 2. The easements hereby conveyed as described in
Section 1 hereof are for the purpose of enabling the City, its
agents, servants and assigns, to install, lay, erect, construct,
maintain, operate and repair a certain sewer pipe or sewer main
which is to be placed in, on, upon, or across said property
described, together with all the useful, necessary and proper
adjuncts, appurtenances manholes and appliances in connection
therewith.
SECTION 3. This ordinance shall be in full force and
effect ten days after its passage and approval.
