AN ORDINANCE REPEALING SEC^1ION 5-32 OF THE CODE OF ORDINANCES OF
THE CITY OF CAPE GIRARDEAU, MISSOURI, AND ENACTING A NEW SECTION
5-32 IN LIEU THEREOF RELATING TO LIQUOR LICENSES
NOW, THEREFORE, BE I^1 ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. Section 5-32 of the Code of Ordinances of the
City of Cape Girardeau, Missouri reading as follows:
"A license for the sale of intoxicating
liquor at retail in the original package may
be granted in accordance with the other
provisions of this chapter for each two thousand
(2,000) persons or major fraction thereof who
are residents of the city. A license for the sale
of intoxicating liquor by the drink may be granted
in accordance with the other provisions of this
chapter for each one thousand (1,000) persons or
major fraction thereof who are residents of the
city. The number of residents of the city shall
be determined by United States census."
is hereby repealed.
SECTION 2. A new Section 5-32 of the Code of Ordinances of
the City of Cape Girardeau, Missouri, is enacted in lieu thereof,
reading as follows:
"A license for the sale of intoxicating liquor
at retail in the original package may be granted
in accordance with the other provisions of this
chapter for each two thousand (2,000) persons or
major fraction thereof who are residents of the
city, plus one (1) additional license. A license
for the sale of intoxicating liquor by the drink
may be granted in accordance with the other provisions
of this chapter for each one thousand (1,000) persons
or major fraction thereof who are residents of the
city. The number of residents of the city shall be
determined by United States census."
SECTION 3. if any section, subsection, sentence, clause,
phrase or portion of,this ordinance is for any reason held invalid
or unconstitutional by any Court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
SECTION 4. This ordinance shall be in full force and effect
ten days after its passage and approval,
