AN ORDINANCE ACCEPTING EASEMENTS FOR SEWERS IN SEWER DISTRICT
NOS. 10B & 15A AND 10C & 15B, FROM EARL LONDON; RALPH L. FENDER
AND RUTH PENDER; ROY MURAKA_MI JR. AND SHIRLEY MURAKAMI; DAVID

WHEREAS, Earl London; Ralph L. Pe_nder and Ruth.Pender;
Roy Murakami Jr. and Shirley Murakami; David C. L. O'Connell
and Jane O'Connell; Clark E. Ervin and Thelma J. Ervin; Delores
Klaus Luton and Wilbur D. Luton; Richard Lee Francis and Joyce
J. Francis; Robert V. Strickland and Jeanette L. Strickland;
Melvin J. Ayers and Dorothy J. Ayers; L. H. Landgraf Real Estate
and Development Co., Inc.; Russell G. Heiney and Nancy K. Heiney;
Romona Ates Shock; and Richard Kaempfe and Helen Kaempfe, have
executed easements for sewer in Sewer District Nos. 10B & 15A
and 10C & 15B, conveying to the City of Cape Girardeau, Missouri,
land all in the City of Cape Girardeau, Missouri, and all as
more fully described hereinafter in the ordinance, and the
City desires to accept such easements and have the same recorded;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. The City of Cape Girardeau, Missouri, hereby
accepts easements for sewers, executed by Earl London; Ralph L.
Pender and Ruth Fender; Roy Murakami Jr. and Shirley Murakami;
David C. L. O'Connell and Jane O'Connell; Clark E. Ervin and
Thelma J. Ervin; Delores Klaus Luton and Wilbur D. Luton; Richard
Lee Francis and Joyce J. Francis; Robert V. Strickland and
Jeanette L. Strickland; Melvin J. Ayers and Dorothy J. Ayers;
L. H. Landgra£ Real Estate and Development Co., Inc.; Russell G.
Heiney and Nancy K. Heiney; Romona Ates Shock; and Richard Kaempfe
and Helen Kaempfe, conveying to the City of Cape Girardeau, Missouri,
easements for sewers in Sewer District Nos. 10B & 15A and 10C & 15B
on the following described real estate located in the City and
County of Cape Girardeau, Missouri:
EarlLondon.
Part of Lot 8, Block G. Capaha Gardens, described
as follows: A strip of land the right hand boundary
of which lies 20 feet from the following reference
line, and the left hand boundary is,the southeast line
of said Lot 8; the reference line being described as
follows.: Begin at the extreme 'east corner of Lot`8
on the center of Capaha Trail; thence South 42° 34'
West to the west line of Lot 8 and there terminating.
Ralph L. Pender and Ruth Pender.
Part of a tract of land in Lot 12, Block G,
Capaha Gardens; as same is described in a deed
recorded in Book 261 at Page '153 in the land
records of Cape Girardeau County, Missouri, being a
strip of land the south boundary line of which is
the south line of said tract ;and the north boundary
line lies 20 feet north, or right, of the following
described line: Begin at the extreme south corner
of said tract; thence North 46° 35' West, 328 feet
to the extreme west corner of Said tract,.and there
terminating.

Part of a tract of land in Lot .2,: Block G,,
Capaha Gardens, as same is described in a deed
recorded in Book 245 at Page 318 in the :land
records of Cape Girardeau County, Missouri, being
that part of said tract lying north :of a line
drawn parallel to and 20 feet south of the
following described liner Begin at the northeast
corner of said tract; thence North 460 35' West,
51 feet, more or less, to the west .line of said
tract, extended north, and there terminating.
David C.L. O'Connell and Jame 'O'Connell.
Part of Lot 1, Block G, Capaha Gardens, being
a tract of land as same is described in Book 229
at Page 329 in the land records of Cape Girardeau
County, Missouri, being all that part lying north
of a line drawn parallel to and 20 feet south of
the following described line: Start at the
northeast corner of a tract of land as same is
described in a deed recorded in Book 245 at Page :318
in the land records of Cape Girardeau County,
Missouri; thence, North 460 35' West, 132 feet,
more or less, to the east line of said tract,
extended north, for a point of beginning; thence
continue North 46° 35' West, 81 feet, more or less,
to the west line of said tract, extended north,
and there terminating.

Part of Lot 1, Block G, Capaha Gardens, being
a tract of land as same is described in Book '131
at Pages 440 and 534, in the :land records of Cape
Girardeau County, Missouri, and being all that part
lying north .of a line drawn parallel to and 20 _feet
south of the following described line: Start at the
northeast corner of Lot 1, in the center of Capaha
Trail; thence South 460 35' East, 37 feet, more or
less, to the west line of said tract extended north;
thence continue South 460 35' vast, 80 feet, more or
less, to the east line of said tract extended north,
and there terminating.

being a strip of land 5 feet wide off of the west
side; and 5 feet wide off of the south side of a
tract of land as said tract is described in a
deed recorded in Book 237 at Page 625, in the land
records of Cape Girardeau County, Missouri.

Part of Lot 2, Block F, Capaha Gardens,
described as follows:
A strip of land 5 feet wide off of the east
side of Lot 2, beginning at the southeast corner
of said lot; thence north along the east line of
said lot, 185 feet; and thence, in a northwest
direction, a strip of land 5 feet wide on each
side of the line, a distance of 181.8 feet to a
point on the north line of said Lot 2, at a
point 190.5 feet west of the northeast corner of
said Lot 2, and there terminating.
Robert V. Strickland and Jeanette L. Strickland.
Part of Lot 7, Block F, Capaha Gardens,
described as follows;
The west 5 feet of a tract described in a
deed recorded in Book 270 at Page 828 in the
land records of Cape Girardeau County, Missouri.

described as follows:
The west 5 feet of a tract described in a
deed recorded in Book 261 at Page 559 in the

south line of said tract :and extending north 30.5
feet, and there terminating.

and itis ordered that said easements be recorded in the Office
of the Recorder of Deeds of Cape Girardeau County, Missouri.
SECTION 2. The easements hereby conveyed as described
in Section 1 hereof are for the purpose of enabling the. City,,
its agents, servants and assigns, to install, lay, erect,
construct, maintain, operate and repair a certain sewer pipe
or sewer main which is to be placed in,, on, upon, or across
said property described, together with all the useful, necessary
and proper adjuncts, appurtenances, manholes, and appliances
in connection therewith.
SECTION 3. This ordinance shall be :in full force and
effect ten days after its passage and approval
