AN ORDINANCE REPEALING SECTION 26-123 OF THE CODE OF ORDINANCES.
OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AND ENACTING A NEW
SECTION IN LIEU THEREOF, PERTAINING TO TRUCK PARKING REGULATIONS
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION A .. That Section 26-123 of the Code of Ordinances
of the City of Cape Girardeau, Missouri reading as follows:
"Sec. 26-123, Trucks; parking regulations generally.
It shall be unlawful for any person to stand or
park a truck tractor, with a trailer, semi -trailer
or pole trailer attached or in any manner carried on
said truck tractor, or any truck having a load
capacity of one and one-half (1.1/2) tons or more
on any street of the city, between the hours of
6:00 p.m. and 6:00 a.m., for a period of more
than one hour."
is hereby repealed and a new section enacted in lieu thereof
as shown in Section 2 of this ordinance.
SECTION 2. That a new Section 26-123 of the Code of
Ordinances of the City of Cape Girardeau, Missouri, is hereby
enacted reading as follows:
"Sec. 26-123. Trucks;parking regulations generally.
It shall be unlawful for any person to stand
or parka truck tractor, or trailer, se-aii-trailer,
or pole trailer having a length in excess of
twenty (20) feet, or any truck having a load
capacity of one and one-half (1 1/2) tons or more
on any street of the city, between the hours of
6:00 p.m. and 6:00 a.m., for a period of more than
one hour."
SECTION 3. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any Court of competent jurisdiction,
such portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
SECTION 4. It is the intention of the governing body
and it is hereby ordained that the provisions of this ordinance
shall become and be made a part of the Code of Ordinances, City
of Cape Girardeau, Missouri.
SECTION 5. This ordinance shall be in full force and
effect ten days after its passage and approval.
