AN ORDINANCE AMENDING SECTION 7-3 OF THE CODE OF ORDINANCE OF THE
CITY OF CAPE GIRARDEAU, MISSOURI, BY ADDING THERETO.NEW SUBSECTIONS
(H) AND (I), RELATING TO THE BUILDING CODE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION 1. Subsection (f) of Section 300.1 of the National
Building Code is hereby repealed in its entirety and a new Subsection
(f) is hereby enacted in lieu thereof, which shall become Section
7-3(h) of the Code of Ordinances of the City of Cape Girardeau,
Missouri, to read as follows:
"300.1(f) Institutional Occupancy.
All buildings and structures, or parts thereof, shall be
classified in the institutional (i) use group in which
people suffering from physical limitations. because of health
or age are harbored for medical or other care or treatment,
or in which people are detained for penal or correctional
purposes, or in which the liberty of the inmates is restricted,
including among others, asylums, homes for the aged, hospitals,
houses of correction, infirmaries, jails, nurseries, nursing
homes, orphanages, penal institutions, reformatories, sanitariums."
SECTION 2. Subsection (h) of Section 300.1 of the National
Building Code is hereby repealed in its entirety and a new Subsection
(h) is hereby enacted in lieu thereof, which shall become Section
7-3(i) of the Code of Ordinances of the City of Cape Girardeau,
Missouri, to read as follows:
"300.1(h) Residential Occupancy.
All buildings and structures or parts thereof shall be
classified in the residential (R) use group in which families
or households live, or in which sleeping accommodations are
provided for individuals with or without dining facilities,
excluding.those that are classified as institutional buildings,
including among others, apartments, club houses, convents,
dormitories, dwellings, hotels, lodging houses, motels,
multifamily. houses."
SECTION 3. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any Court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
SECTION 4. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances, City of Cape
Girardeau, Missouri, and the sections of this Code may be renumbered
to accomplish such intention.
SECTION 5. This ordinance shall be in full force and effect
ten days after its passage and approval.
