AN ORDINANCE ESTABLISHING THE :BOUNDARIES OF SEWER DISTRICT
NO. 12 -SS -1, A SUBDIVISION OF SEWER DISTRICT NO. 12, APPROVING
THE PLANS FOR THE CONSTRUCTION OF A. SYSTEM OF SANITARY LATERAL
SEWERS. IN SEWER DISTRICT NO. 12 -SS -1 AND AUTHORIZING THE CONSTRUCTION
OF SANITARY LATERAL SEWERS IN SEWER DISTRICT NO. 12 -SS -1 UNDER
A PRIVATE CONTRACT SUBJECT TO CERTAIN PROVISIONS, IN THE CITY
OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI., AS FOLLOWS:
SECTION 1. That .the boundaries of Sewer District
No. 12 -SS -1,.a subdivision of Sewer District No. 12 in the
City of Cape Girardeau, Missouri, shall be as follows:
Part of .the Southeast Quarter of .the Southwest Quarter,
part of .the Northeast Quarter of the Southwest Quarter and
part of. .the Southeast Quarter of .the. Northwest Quarter, Section
19, Township 31 North,. Range 14 East, described as follows:
Begin -at the northwest corner of Brookshire Estates
on .the north -and. south -quarter -quarter section line of the
Southwest Quarter of said Section 19;. thence N 10 15' E, with
.the quarter -quarter section line, 694.7 feet to .the southwest
corner of Woodcrest Hills, a subdivision;. thence continue
N 10 15' E, with said quarter -quarter section line and the
west line of Woodcrest Hills, 665.3 feet to the northwest
corner of Woodcrest Hills, at.the southwest corner of the.
Southeast Quarter of .the Northwest Quarter of said Section
19;. thence with'.the following courses and distances with boundaries
of Wildwood Subdivision N 2° 16' E, with -the north and south -
quarter -quarter section line of the Northwest Quarter of said
Section 19, 1408.21 feet;. thence S 890 18' E., 798.96 feet;
thence S. 2° 16' W, 863..68 feet; thence S. 10' 15' W., 552.4
feet to the north line of said Woodcrest Hills; .thence with
the following courses and distances with the boundaries of
said Woodcrest Hills, S. 890 16' E., 591.0 feet; thence S.
10 33' W., .70.7 feet to.the west line of Cape Rock Drive;
.thence continue with.the boundary of said Woodcrest Hills
and the west line of Cape Rock Drive, Southwesterly and Southerly,
874.7 feet to the southeast corner of Woodcrest Hills; thence
leaving the boundary of Woodcrest Hills and continue with
.the west line of Cape Rock Drive, S. 20 W., 493.3 feet to
.the south line of..the Northeast Quarter of the Southwest Quarter_4 `;i
of said Section 19; thence continue S. 2° W., with the west
line of Cape Rock Drive, 26.0 feet to.the northeast corner
of Sewer District 12 -SS; .thence Westerly with -the extension
of .the north line of Brookshire Estates and with -the north
line of Sewer District 12 -SS, 267.3 feet to the northeast
corner of Brookshire Estates; thence S. 891 42' W., with the
north line of Brookshire Estates and the north .line of Sewer
District 12 -SS, 767.5 feet to the point of beginning.
SECTION 2. That.the plans for the construction of
a system of sanitary lateral sewers to serve Sewer District
No. 12 -SS -1, a copy of which -is on file in .the office of the
City Clerk, are hereby approved and ordered filed.
SECTION 3. That the owners of lands in said Sewer
District No. 12 -SS -1 are hereby granted permission to construct
said system of sanitary lateral sewers in Sewer District No.
12 -SS -1 and to connect same to existing sewers in Sewer District
No. 12 -SS subject to the following provisions.
1. That proper authority has been secured to proceed
from the Missouri Clean Water Commission.
2. That all permanent easements for said sewers on
private property are made to the City of Cape Girardeau, Missouri,
prior to execution of a contract for the work of construction
of said sewers.
3. That all City Ordinances, Standard Specifications
of the City and State laws applicable to this project will
be observed in all respects.
4. That the quality of the work and materials be
inspected by the agents of the Department of Public Works
of the said City, and the cost of said inspections be paid
to said City following the completion of the work and its
acceptance by said City and the Missouri Clean Water Commission.
SECTION 4. This ordinance shall be in full force
and effect ten days after its passage and approval.
