AN ORDINANCE ACCEPTING AN EASEMENT FOR SEWERS IN SEWER DISTRICT
NO. 14-E-1 &'12 -LL -1 FROM CAPE GIRARDEAU DOCTORS' PARK, INC.,
IN THE CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI.
WHEREAS, Cape Girardeau Doctors' Park „Inca, a Missouri
Corporation, has executed an easement for sewers in Sewer
District No. 14-E-1 & 12 -LL -1 conveying to the City of Cape
Girardeau, Missouri, land all in the City of Cape Girardeau,
Missouri and all as more fully described hereinafter in the
ordinance, and the City desires to accept such easement and
have the same recorded;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF
THE CITY OF CAPE GIRARDEAU, MISSOURI., AS FOLLOWS:
SECTION 1. The City of Cape Girardeau, Missouri,
hereby accepts an easement for sewers, executed by Cape Girardeau
Doctors' Park, Inc., a Missouri Corporation, by Melvin C.
Kasten, M.D., President, conveying to the City of Cape Girardeau,
Missouri, an easement for sewers in Sewer District No. 14-
E-1 & 12 -LL -1 on the following described real estate located
in the City and County of Cape Girardeau, Missouri:
A part of Lot 29 and part of a roadway and utility
easement, Doctors' Park Subdivision, being a strip
of land 10 feet in width, lying 5 feet either side
of the following center line:
Start at the southeast corner of "Doctors' Park",
a subdivision; thence S. 71' 33' W., with the south
line of said Doctors' Park, 262.0 feet to the point
of beginning;. thence N. 1° 08' E., 90.0 feet and
there terminating.
and it is ordered that said easement be recorded in the Office
of the Recorder of Deeds of Cape Girardeau County, Missouri.
SECTION 2. The easement hereby conveyed as described
in Section 1 hereof is for the purpose of enabling the City,
its agents, servants and assigns, to install, lay, erect,
construct, maintain, operate and repair a certain sewer pipe
or sewer main which is to be placed in, on, upon, or across
said property described, together with all the useful, necessary
and proper adjuncts, appurtenance's,manholes, and appliances
in connection therewith.
SECTION 3. This ordinance shall be in full force
and effect ten days after.its passage and approvpl.
