AN ORDINANCE AMENDING SECTION 5-22 OF THE CITY CODE TO ALLOW THE ISSUANCE OF SIX MONTH LIQUOR LICENSES BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: SECTION 1. Section 5-22 of the Code of Ordinances of the City of Cape Girardeau, Missouri, is hereby repealed in its entirety. SECTION 2. A new Section 5-22 of the Code of Ordinances of the City of Cape Girardeau, Missouri, is hereby enacted, to read as follows: Sec. 5-22. Required; Duration,. (a) No person shall, either by himself or through the use of agents or servants, engage in the manufacture, brewing, sale or distribution of intoxicating liquors within the city, without first, having taken out and obtained a license authorizing such manufacture, brewing, sale or distribution in compliance with the terms of this chapter. The license shall be issued for a period of one year from June thirtieth, of each year, and persons desiring to secure licenses after June thirtieth shall pay for such .portion of the license year remaining at the time such license is issued. Thereafter, all renewals of licenses shall be made on June thirtieth of each year. (b) When the city council, in its sole discretion, determines that there is good reason not to issue a license under this chapter for a period of one year, it may issue a license for a period of six months. At the end of the six, month period the council shall consider whether to renew the license for an additional six months or to June thirtieth, whichever period is shorter. Persons licensed under this subsection shall pay only a prorated license fee. .SECTION 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof.
