AN ORDINANCE ACCEPTING PERMANENT EASEMENTS
FROM RALPH EDWARDS SPORTSWEAR, INC., AND
DAVID H. LEMMON AND PATRICIA.LEMMON FOR
STORM DRAINAGE PURPOSES
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION 1. The. City of Cape Girardeau hereby accepts a
Permanent Easement executed by Ralph Edwards Sportswear, Inc.,
conveying a Permanent Easement to the City in the following
described. real estate located in the City and County of Cape
Girardeau, Missouri:
Part of Lot 1 of Out Lot No. 81 of U.S. Survey No
21.99, Townships 30 and 31 North, Range 13 East of the
Fifth Principal Meridian in the City of . Cape
Girardeau, Missouri, and, being more particularly
described as follows: Beginning at an iron pin on the
East line of.Broadview Street, said iron pin being the
Southwest corner of Lot 9 of Nothdurft's Partition of
the south part of Lot No. 4 of the Southwest Quarter
of. Out Lot 80, the East part of Lot 1 and the
Northeast part of Lot No. 2 of Robert Sturdivant's
Subdivision of out Lot 81, aforesaid U.S. Survey No.
.2199; thence South 550 51.' 40" East along the South
line of aforesaid Lot 9 a distance of 344.65 feet to
an: iron pin at the Southeast corner of said Lot 9;
thence South 071 26" 10" West a distance of 74.74 feet
to an iron pin at the Northeast corner of Lot 8 of
aforesaid Nothdurfts Partition; thence North 550 51'
4011West along the North line of aforesaid, Lot 8 a
distance of 357.19 feet to an iron pin on the
aforesaid East line of Broadview Street, said iron pin
being the Northwest corner of said Lot 8; thence North
160 38' 52" East along said East line of Broadview
Street a distance of 70.00 feet to the point of
beginning containing 0.54 acre and subject to any
easements, reservations or restrictions on record or
°now in effect.
SECTION 2. The City of Cape Girardeau hereby accepts a
Permanent Easement executed by Ralph Edwards Sportswear, Inc.,
conveying a Permanent Easement to the. City in the following
described real estate located in the City and County of Cape
Girardeau, Missouri:
Part of Lot 9 of Nothdurft's Partition of the South
part.of Lot 4 of the Southwest Quarter of Outlot 80 of
U.S. Survey No. 2199, Townships 30 and 31 North, Range
13 East of the Fifth Principal Meridian in the City of
Cape Girardeau, Missouri, and being more particularly
described as follows: Beginning at an iron pin on the
East line of Broadview Street, said iron pin being the
Southwest .corner of aforesaid Lot 9 of Nothdurft's
Partition; thence North 161 38' 52" East along ;said
East line a distance of 35.0 feet; thence South 730 21'
08 East a distance. of 20 feet thence South 160 38'
52" West a distance of 300 feet; thence south 730 21'
08" East a distance of 20 feet; thence South 160 38'
52" West a distance of 62.61 feet to a point on the
South line of aforesaid Lot 9 of Nothdurft's
Partition, said point also being the North lime of the
North 50 feet of old abandoned railroad right -of -way -
thence North 550 51' 40" West a distance of 41.94 feet
to.the point of beginning.
SECTION 3. The City of Cape Girardeau hereby accepts a
Permanent Easement executed by Ralph Edwards Sportswear, Inc.,
conveying a Per manent Easement to the City in the following
described real estate located in the City and County of Cape
Girardeau, Missouri:
Part of Lot 9 of Nothdurft's Partition of the south
part of Lot 4 of the southwest Quarter of Outlot 80 of
U.S. Survey No. 2199, Townships -30 and 31 North, Range
13 East of the. Fifth Principal Meridian in the City of
Cape Girardeau, Missouri, and being more particularly
described as follows: Beginning at an iron pin at the
Southeast corner of aforesaid. Lot 9 of Nothdurft's
Partition, said iron pin also being the Southwest
corner of a tract of land conveyed to the City of Cape
Girardeau, Missouri, by deed recorded in Book 359,
Page 440, in the Office of the Recorder of Deeds of
Cape Girardeau County, Missouri; thence North 550 51'
40" West. along the South line of aforesaid Lot 9 of
Nothdurft's Partition, said line. also being the North
line of the North 50 feet of the old abandoned
railroad right-of-way, a distance of 22.39 feet;
thence North 070 26' 10" East a distance of 500 feet;
thence South 820 33' 50" East a distance of '20 feet to
a point on the East line of aforesaid Lot 9 of
NothdurftIs Partition; thence South 070 26' 10 West
along said East line a distance of 510.06 feet to the
point of beginning.
SECTION 4. The City of Cape Girardeau hereby accepts a
Permanent Easement executed by David H. Lemmon and Patricia Lemmon
conveying a Permanent Easement to the City in the following
described real estate located in the City and County of Cape
Girardeau, Missouri:
All that part of Lot 5 of Robert Sturdivant's
Subdivision of Out Lot 81, U.S.P. Survey 2199, in the
City of Cape Girardeau,. Missouri, described as
follows, to -wit;
Start at the Northwest corner of said Lot 5 of
Sturdivant's Subdivision; thence. in a Southerly
direction with the West line of said Lot 51 370.0 feet
to a point where said line intersects the Northeast
right-of-way line of the Missouri Pacific Railroad;
thence South 560. 49' East, with said Northeast line
550.0 feet to the point where it intersects the West
right-of-way line of U. S. Route 61 for a beginning
cornea; thence North 80 33' West, with the West
right -of --way line of said U. S. Route 61, 145.0 feet;
thence South 810 27' West 162.5 feet to the Northeast
right-of-way line of the Missouri Pacific Railroad;
thence South 560 49' East, with said Northeast line,
21,7..7 feet to the beginning corner. ,
SECTION 5. This ordinance shall be in full force and effect
ten days after its passage and approval.
