AN ORDINANCE ACCEPTING PERMANENT EASEMENTS
FROM GEORGE POON AND THE CITY OF CAPE
GIRARDEAU, MISSOURI FOR STORM DRAINAGE
PURPOSES
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION 1. The City of Cape Girardeau hereby accepts a
Permanent Easement executed by George Poon, conveying a
Permanent Easement to the City in the following described real
estate located in the City and County of Cape Girardeau,
Missouri:
All that part of the Missouri Pacific Railroad
right-of-way which was abandoned by order of the
Interstate Commerce Commission by Order decided June
3, 1985, in which I have any ownership interest by
virtue of the fact that said railroad right-of-way
abuts certain property belonging to me, said abutting
property is described as follows:
All that part of Lot 5 of Robert Sturdivant's
Subdivision of Out Lot 81, in Survey 2199, in the City
of Cape Girardeau, Missouri, lying, being and situate
West of the right-of-way of U.S. Highway 61, described
by metes and bounds as follows:
Beginning at the northwest corner of Lot 5 of said
subdivision and run South along the West boundary line
of Lot 5, 370.0 feet to a point where said boundary
line intersects the northeast boundary line of
right-of-way of the Missouri Pacific Railroad; thence
southeasterly, along the said northeast right-of-way
line, 87.5 feet to an iron pin for a beginning corner;
thence continue along said northeast right-of-way
244.8 feet to a point; thence North 810 27' East 162.5
feet to the West right-of-way line of U.S. Highway 61;
thence North 8° 33' West along the West right-of-way
line of U.S. Highway 61, 174.55 feet; thence South 790
41' West, 345.36 feet to the point of beginning.
SECTION 2. The City of Cape Girardeau hereby establishes a
Permanent Easement executed by the City of Cape Girardeau,
Missouri, establishing a Permanent Easement to the City in the
following described real estate located in the City and County of
Cape Girardeau, Missouri:
All that part of Lot No. 5 of Robert Sturdivant's
Subdivision of Out Lot No. 81 in Survey No. 2199, in
the City and County of Cape Girardeau, Missouri,
lying, being and situate West of the right-of-way of
U.S. Highway 61, and North of the right-of-way of the
Missouri Pacific Railroad, EXCEPT that portion thereof
described as follows: Beginning at the northwest
corner of Lot No. 5 aforesaid; thence South along the
West boundary line of Lot 5, 370.0 feet to a point
where the said boundary line intersects with the
Northeast boundary line of the right-of-way of the
Missouri Pacific Railroad; thence Southeast along the
said Northeast right-of-way line, 87.5 feet to an iron
pin for a beginning corner; thence continuing along
the said Northeast right-of-way line, 462.5 feet, more
or less, to a point where said right-of-way intersects
with the West right-of-way line of U. S. Highway No.
61; thence North 81 33' West along the right-of-way
line of U. S. Highway No. 61, 319.55 feet to a point
marked on a driveway curb; thence at an angle of 881
14', 345.36 feet South 790 41' West to the place of
beginning, and EXCEPT that part conveyed to Tomland
Industries, Inc. by Warranty Deed recorded in Book 330
at Page 324 of the land records of Cape Girardeau
County, Missouri.
Together with all easements and agreements relative to
right-of-way for sewer, light, water, and utility and
roadway purposes acquired by the Grantors in the
acquisition of said real estate, as referred to in the
Warranty Deed dated March 6, 1948, and which said deed
is recorded in the deed record book 138 at page 424
thereof of the land records of Cape Girardeau County,
Missouri, or otherwise of record. (The warranties of
this deed are subject to all easements of record and
visible easements.
SECTION 3. This ordinance shall be in full force and effect
ten days after its passage and approval.

Dear Mayor and Council Members:
Subject: Ordinance Accepting Permanent Easement for Storm Drainage Purposes
This City Council agenda item provides for the consideration of an ordinance which
would formally accept a permanent easement from Mr. George Poon for storm drainage
purposes. This permanent easement is necessary over property Mr. Poon owns in conjunction
with the economic development block grant project at Tri -Con Industries.
This easement would specifically allow the construction of storm drainage
improvements that will be on a portion of the old railroad right-of-way located between the
Tri -Con parking lot and Kingshighway. In order to continue with this project, it is
recommended that the City Council give first reading to the attached ordinance accepting
this permanent easement.
