AN' ORDINANCE REAFFIRMING THE ACTION OF THE
CITY COUNCIL DECLARING IT NECESSARY TO
IMPROVE, PROVIDING FOR TH. E IMPROVEMENT,
DIRECTING THE CITY MANAGER 'TO ENTER INTO A
CONTRACT TO DO THE WORK, PROVIDING FOR THE
PAYMENT OF THE 'WORK, AND PROVIDING FOR THE
I-SSUANCE OF SPECIAL TAX BILLS IN AN AMOUNT
NOT TO EXCEED $,0.0244 PER SQUARE FOOT IN
PAYMENT OF THE COST 0'F CERTAIN SEWER
IMPROVEMENTS IN SEWER DISTRICT NO. 14-E-2
AND SEWER DISTRICT NO. 12=LL-A-1, IN THE
GREATER CAPE GIRARDEAU COMMERCIAL CENTER, IN
THE CITY OF CAPE GIRARDEAU; MISSOURI, WITH
THE BALANCE TO BE PAID FROM GENERAL REVENUE
FUNDS
WHEREAS, the City Council adopted Resolution No. 214 on August
1.8, 1986, declaring that a public necessity exists for
rehabilitating an existing sewage lift station and declaring the
Council's intention to have this project done by contract and to
tax bill the benefitted property in an amount not to exceed
$0.0244 per square foot and
WHEREAS, the City Manager thereafter filed with the City Clerk
for public inspection the plans and specifications for the
project, an estimate of ..the total cost of the project, including
construction, construction contingency and fees and other
expenses, and an estimate of. the portion of the total cost to be
.a'ss.essed.'against each property to be benefitted by the project; and
WHEREAS, 'a public hearing was held before the City Council at
7:30 P.M, on September 2, 1986, at which citizens and all
interested parties were afforded the opportunity to express their
assent or objection to.the project; and
WHEREAS, the. City Clerk. published notice for seven (7)
consecutive insertions in the Southeast Missourian that the items
filed by the City Manager in connection with this project were
available for inspection and that the aforementioned public
hearing would be held at the time and place and for the purpose
stated above; and
WHEREAS, a contract.has.bee'n entered into with Monroe Plumbing
and Heating Co. for construction of the project; and
WHEREAS, all requirements of law and ordinance for special
benefit ayssessment projects have been complied with;
NOW, .THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. The City Council hereby levies and assesses a
special tax in the amount of $0.0205878 per square foot in favor
of the City of Cape Girardeau and against the lots, tracts and
parcels of land benefitted by the sewer improvement in proportion
to the number of square feet benefitted by the sewer system so
improved.
SECTION 2. The City Clerk is hereby directed to prepare tax
bills pursuant to the above levy and assessment. Such tax bills
shall be issued on the date the City council accepts the sewer
improvement. Such tax bills shall bear interest from sixty ( 6 0 )
days after their issuance at the rate on ten .(10) year United
States Treasury Notes as established at the most recent auction
preceding the date of issuance.
SECTION 3. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not. affect the validity of the
remaining portions hereof.
SECTION 4. This ordinance shal.1 be in full. force and effect
ten days after its passage and approval.
