AN ORDINANCE VACATING THE CITY'S INTEREST IN
AN ALLEY RUNNING WEST FROM GIBONEY BETWEEN
MAPLE AND WALNUT STREETS, IN THE CITY OF
CAPE GIRARDEAU, MISSOURI
WHEREAS, the City Council has received a request from
Charles E. Miller, 737 R. Giboney Street that the City vacate
an alley running West from Giboney between Maple and Walnut
Streets and more particularly described in Section l hereof; and
WHEREAS, the City Council set the date of September 21,
1987 for a public hearing on this request; and
WHEREAS, at least ten (10) days notice of the time and
place of this hearing was published in a newspaper of general
circulation in the City; and
WHEREAS, a public hearing was held on September 21, 1987 at
which all interested parties were afforded the opportunity to
speak in favor of or in opposition to the proposed alley
vacation; and
WHEREAS, the City Council has determined that the alley in
question is not necessary or needed for any of the purposes for
which it was dedicated and established; and
WHEREAS, it is in the public interest that the alley be
vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAUr MISSOURI, AS FOLLOWS:
.SECTION 1. The City's interest in the alley on the
following described real estate:
An alley running West from Giboney between Block 5 and
Block f of Giboney Houck's Second.Subdivision.
is hereby vacated.
SECTION 2. This ordinance shall be in full force and effect
ten days after its passage and approval.
