ORDINANCE NO. 11
AN ORDINANCE VACATING THE CITY'S INTEREST IN
A SEWER EASEMENT NEAR KINGSWAY DRIVE AND
ROUTE W IN SEWER DISTRICT 12 -ZZ, IN THE
CITY OF CAPE GIRARDEAU, MISSOURI
WHEREAS, the City Council has received a request from
Robert Penrod, developer of Cedar Ridge Subdivision that the
City vacate a sewer easement on property owned by him near
Kingsway Drive and Route W and more particularly described in
Section 1 hereof; and
WHEREAS, the City Council has determined that the sewer
easement in question is not necessary or needed for any of the
purposes for which it was dedicated and established; and
WHEREAS, it is in the public interest that the easement be
vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. The City's interest in the sewer easement on
the following described real estate in Sewer District 12 -ZZ:
A tract of land designated on the plat of Cedar Ridge
Subdivision as a sanitary sewer easement more
particularly described as follows:.
A strip of land 5 feet on both sides of a centerline
with a point of beginning 51.1 feet West of the
Southeast corner of Lot 29 of Cedar Ridge Subdivision
and on the North line of Kingsway Drive; thence North
to the South boundary of a 25 foot wide easement along
the North line of said Lot 29, and there terminating.
is hereby vacated.
SECTION 2. This ordinance shall be in full force and effect
ten days after its passage and approval.
