AN ORDINANCE ANNEXING CERTAIN TRACTS OF LAND
TO THE CITY OF CAPE GIRARDEAU, MISSOURI;
SAID TRACTS OF LAND BEING PARTS OF THE
NORTHWEST QUARTER OF SECTION 19 AND PART OF
THE EAST ONE-HALF OF THE SOUTHWEST QUARTER
OF- SECTION 18, ALL IN TOWNSHIP 31 NORTH,
RANGE 14 EAST, CAPE GIRARDEAU COUNTY,
MISSOURI
WHEREAS, Billy L. Obgorn and Rebecca B. Ogborn, husband and
wife and Donald C. Dennington have presented to the City Council
of Cape Girardeau, Missouri, their verified petitions requesting
annexation and signed by the owners of all fee interest of record
in all tracts of real property located within the area proposed to
be annexed; and
WHEREAS, a public hearing was held January 19, 1987, after due
notice was given according to Chapter 71.012 Revised Statutes of
Missouri; and
WHEREAS, at said public hearing all interested persons were
allowed to present evidence regarding the proposed annexation; and
WHEREAS, the City Council of Cape Girardeau, Missouri, has
determined that the annexation is reasonable and necessary to the
proper development of the City and further that the City has the
ability to furnish normal municipal services to the area to be
annexed within a reasonable time.
WHEREAS, the City Council has determined that the property
proposed to be annexed is contiguous and compact and adjacent to
the existing corporate limits of the City of Cape Girardeau,
Missouri, and further that the land proposed -to -be annexed is in
an unincorporated area.
NOW, THEREFORE, BE ISI' ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. That the corporate limits of the City of Cape
Girardeau, Missouri, shall be extended so as to annex the
following described unincorporated areas of land which are
adjacent to the existing corporate limits of the City of Cape
Girardeau, and to extend the limits of the City over said
territory as described herein below, to -wit:
37.22 acres, being part of the north half of Lot 1 of the
Northwest Quarter of Section 19 and part of the East Half
of the Southwest Quarter of Section 18, all in Township 31.
North, Range 14 East, Cape Girardeau County, Missouri,
described as follows:
Beginning at the northwest corner of the Northeast Quarter
of the Northwest Quarter of Section 19; thence along the
western boundary line thereof South 20 00' West, 11238.00
feet to a point being marked by a steel fence post from
which a Persimmon tree 7" dia. bears North 4.0 feet; thence
South 880 30' East, 765.00 feet to a point; thence North
1,946 feet to a point on the southern right-of-way line of
a County Road; thence along said right-of-way line, North
510 151- West, 100.00 feet to a point; thence North 531 20'
West, 400.0 feet to a point, thence North 500 00' West,
400.0 feet to a point on the Western boundary line of the
East Half of the Southwest Quarter of Section 18; thence
along the said line South 01 15' East, 1,220.0 feet to the
point of beginning. Except part of the Northwest Quarter
of Section 19, Township 31 North, Range 14 East, City and
County of Cape Girardeau, Missouri further described as
follows: Begin at the Northwest Corner of Lot 4 of
Wildwood Subdivision, said corner marked by a 1" pipe and a
metal fence post; thence N. 881 37' 30" East, 765.0 feet
along the North line of said Subdivision to a 1" pipe,
thence North 490 22' 40" West, 1021.3 feet to a 1" pipe on
the West line of the Northeast Quarter of the Northwest
Quarter of said Section 19; thence South 00 52' 30 East,
683.4 feet along said Quarter Quarter line to the point of
beginning containing 6.0002 acres.
The Northwest Quarter of Section 19, Township 31 North,
Range 14 East, City and County of Cape Girardeau, Missouri,
further described as follows: Begin at the Northwest
Corner of Lot 4 of Wildwood Subdivision, said corner marked
by a 1" pipe and a metal fence post; thence N. 88° 37' 30"
East, 765.0 feet along the North line of said subdivision
to a 1" pipe; thence North 491 22' 40" West, 1021.3 feet to
a 1" pipe on the West line of the Northeast Quarter of said
Section 19; thence South 01 52' 30" East, 683.4 feet along
said Quarter Quarter line to the point of beginning
containing -6.0002 acres.
SECTION 2. This ordiance shall take affect and be in force
from and after ten days after its final passage and approval.
SECTUIB 3. That the City Clerk is authorized and directed to
cause three certified copies of this ordinance in its final form
to be filed with the Clerk of Cape Girardeau County as provided by
Section 71.012 Revised Statutes of Missouri.
