AN ORDINANCE REPEALING SECTION 26-83 b. OF THE
CITY CODE AND ENACTING A NEW SECTION 26-83 b. IN
LIEU THEREOF RELATING TO DIVIDED ROADS AND
HIGHWAYS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION 1. Section 26.83. b. of the Code of Ordinance of the
City of Cape Girardeau, Missouri, is hereby repealed and a new
Section 26.83 b. enacted in lieu thereof, in words and figures, to
read as follows, to -wit:
Sec 26.83
b. Divided roads, highways. It is unlawful to drive any
vehicle upon any highway or road which has been
divided in two (2) or more roadway by means of a
-- - - - - -physical -barrier-- or -by means-of--a--livid-ing- sec -tion --or delineated by curbs, lines or other markings on the
roadway, except to the right of such barrier or
dividing section, or to make any left turn or
semi -circular or U-turn on any such divided highway,
except at a crossover or intersection.
SECTION 2. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
SECTION 3. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.
SECTION 4. This ordinance shall be in full force and effect
ten days after its passage and approval.
