AN ORDINANCE ESTABLISHING THE BOUNDARIES OF SEWER
DISTRICT NO. 14-T-1, A SUBDIVISION OF SEWER
DISTRICT NO. 12 -TT & 14-T, APPROVING THE PLANS
FOR THE CONSTRUCTION OF A SYSTEM OF SANITARY
LATERAL SEWERS IN SEWER DISTRICT NO. 14-T-1, AND
AUTHORIZING THE CONSTRUCTION OF SANITARY LATERAL
SEWERS IN SEWER DISTRICT NO. 14-T-1 UNDER A
PRIVATE CONTRACT SUBJECT TO CERTAIN PROVISIONS,
IN THE CITY OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION 1. That the boundaries of Sewer District No. 14-T-1,
a subdivision of Sewer• District No. 12 -TT & 14-T in the City of
Cape Girardeau, Missouri, shallbeas fo-llows!.- ---
A part of the Southwest Quarter of Fractional Section 35,
township 31 North, Range 13 East of the Fifth Principal
Meridian, City and County of Cape Girardeau, State of
Missouri, being more particularly described as follows:
Beginning at a point on the South line of Westland Hills
Subdivision as recorded in the land records in the County
Recorders Office in Plat Book No. 4 at Page No. 44, from
which point the Southwest corner of said subdivision bears
South 880 50' 57" West, 833.99 feet; thence North 880 50'
57" East, 655.00 feet along the South line of Westland
Hills Subdivision; thence South 000 08' 42" West, 894.20
feet; thence North 81° 41' 24" West, 433.10 feet to the
beginning of a curve concave to the Southeast having a
radius of 388.69 feet and a central angle of 27° 08' 26";
thence in a Southwesterly direction along said curve 184.12
feet; thence South 710 10' 11" West, 141.43 feet to the
beginning of a curve concave to the Northeast having a
radius of 125.00 feet and a central angle of 891 04' 05";
thence in a Northwesterly direction along said curve 194.32
feet; thence North 191 45' 45" West, 33.72 feet to the
beginning of a curve concave to the Southwest having a
radius of 305.93 feet and a central angle of 171 12' 10";
thence in a Northwesterlydirection along said curve 91.85
feet; thence leaving said curve on a non -tangent line North
530 02' 05" East, 272.35 feet; thence North 00° 08' 42"
East, 298.44 feet; thence North 201 27' 46" East, 245.82
feet to the point of beginning containing 15.34 acres more
or less.
SECTION 2. That the plans for the construction of a system of
sanitary lateral sewers to serve Sewer District No. 14-T-1, a copy
of which is on file in the office of the City Clerk, are hereby
approved and ordered filed.
SECTION 3. That the owners of lands in said Sewer District
No. 14-T-1 are hereby granted permission to construct said system
of sanitary lateral sewers in Sewer District No. 14-T-1 and to
connect same to existing sewers in Sewer District No. 12 -TT &
14-T, subject to the following provisions.
1. That proper authority has been secured to proceed from
the Missouri Clean Water Commission.
2. That all permanent easements for said sewers on private
property are made to the City of Cape Girardeau,
Missouri, prior to execution of a contract for the work
of construction of said sewers.
3. That all City Ordinances, Standard Specifications of the
City and State laws applicable to this project will be
observed in all respects.
4. That the quality of the work and materials be inspected
by the agents of the City engineer of the said City, and
that cost of said inspections be paid to said City
following the completion of the work and its acceptance
by said City and the Missouri Clean Water Commission.
SECTION 4. That this Ordinance shall take effect and be in
full force from and after ten days following its passage and
approval.
