ORDINANCE NO. 1 �
AN ORDINANCE AMENDING SECTION 30-37 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU
RELATING TO OFF-STREET PARKING
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION 1. Section 30-37(f) of the Code of Ordinances of the
City of Cape Girardeau, Missouri, pertaining to off-street parking
and loading requirements with respect to unlicensed motor vehicles
stored in "R" zoned property is hereby repealed in its entirety.
SECTION 2. Section 30-37(c)(3) of the Code of Ordinances of
the City of Cape Girardeau, Missouri, pertaining to off-street
parking and loading requirements with respect to parking spaces in
the_ required _front_ yard is hereby repealed in its entirety and a_
new Section 30-37(c)(3) is hereby enacted in lieu thereof, in
words and figures, to -wit:
Sec. 30-37(c)(3).
Off-street parking space may be located within the front
yard of any "C" or "M" District, but no off-street
parking shall be permitted in the front yard of any "R"
District or in the front yard of any other District when
that property is used for residential purposes except
upon a driveway providing access to a. garage, carport or
parking area for a dwelling, except that a turnaround
space shall be permitted in required front yards in R-1
and R-2 zones where residences face a federal or state
highway or thoroughfare consisting of four (4) or more
travel lanes, upon which parking is not permitted on any
portion of the right-of-way of said highway or
thoroughfare. The purpose of allowing side turnarounds
is to alleviate hazards of automobiles backing out into
the lanes of traffic. Said turnarounds shall be allowed
by the city manager or his designee who shall issue a
permit upon a showing of need by the applicant, and
compliance with the above conditions. Before the permit
shall be granted, the city manager or his designee shall
review the plans submitted by the applicant to ensure
compliance with all other ordinances, to ensure that the
design of the said turnaround is efficient, and does not
interfere with adjoining property.
SECTION 3. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct- and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
SECTION 4. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.
SECTION 5. This ordinance shall be in full force and effect
ten days after its passage and approval.
