ORDINANCE NO. 1
AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF
ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 1815 CAPE
LaCROIX ROAD, CITY AND COUNTY OF CAPE GIRARDEAU,
MISSOURI FROM R-1 TO C-2
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Section 1 of
this ordinance should be rezoned from R-1 Single -Family Dwelling
District to C-2, General Commercial District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Monday, August
7, 1989; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Section
1 from R-1, Single -Family Dwelling District to C-2, General
Commercial District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended to change the
zoning from the present R-1, Single -Family Dwelling District to
C-2, General Commercial District, for the following described
property:
That part of the Northeast Quarter of the Northwest
Quarter, and that part of the Northwest Quarter of the
Northeast Quarter of Section 26, Township 31 North, Range
13 East, County of Cape Girardeau, State of Missouri,
described as follows:
Commence at the Northwest Corner of the Northeast Quarter
of the Northwest Quarter of said Section 26; thence North
880 30' 18" East, with the North line of said Section 26,
a distance of 1264.83 feet, to a point in the center of
Cape LaCroix Creek, the place of beginning; thence
continue,North 881 30' 18" East, with said Section line,
267.02 feet, to a point on the West right-of-way line of
Missouri State Route "W"; thence with said right-of-way
line, South 200 56' East, 90.85 feet; thence South 210
08' East, 21.60 feet; thence departing said Route "W",
South 20 39' 31" West, 478.90 feet to a point in the
center of said Cape LaCroix Creek; thence with said
creek, North 220 16' 35" West, 46.23 feet; thence North
380 53' 15" West, 294.20 feet; thence North 150 11' 44"
West, 315.68 feet, to the place of beginning and
containing 2.4409 acres, more or less.
SECTION 2. The City Council hereby finds and declares that
the property described in Section 1 hereof is at the present time
particularly suitable for the purposes and uses of C-2, General
Commercial District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
SECTION 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
