ORDINANCE NO. 13 CZ
AN ORDINANCE AMENDING CHAPTER 26 OF THE CODE OF
ORDINANCES PERTAINING TO PARKING AND STORAGE OF
VEHICLES, WITH A PENALTY PROVISION
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION 1. Section 26-126 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, entitled "Penalties",
Paragraph b, providing penalties for persons found guilty of
violating Sections 26-111, 26-112, 26-115, 26-116, 26-117, 26-118,
26-120, 26-121, 26-123, 26-124 or 26-125 is hereby repealed in its
entirety and a new section 26-126 b. is hereby enacted in lieu
thereof, in words and figures, as follows, to -wit:
Sec. 26-126. Penalties.
b. Any person accused of violating Sections 26-111,
26-112, 26-115, 26-116, 26-117, 26-118, 26-120,
26-121, 26-123, 26-124, 26-125 or 26-127, upon
entering a plea of guilty, shall pay a fine
according to the following schedule:
(1) Ten dollars (10.00) if paid within seven (7)
days following the violation.
(2) Fifteen dollars (15.00) if paid more than
seven (7) days following the violation.
SECTION 2. A new Section 26-127 of the Code of Ordinances of
the City of Cape Girardeau, Missouri, entitled "Parking in Front
Yard", is hereby enacted, in words and figures, as follows, to -wit:
Sec. 26-127. Parking in Front Yard.
No vehicle shall be parked in the front yard of any
lot in any "R" zoning district or in the front yard of
any lot used for residential purposes in any other zoning
district except on a driveway or turnaround as allowed in
Chapter 30 of the City Ordinances.
SECTION 3. Section 26-161 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, entitled "Vehicles Left
Unattended" is hereby repealed in its entirety and a new Section
26-161 entitled "Vehicles Left Unattended" is hereby enacted in
lieu thereof, in words and figures, as follows, to -wit:
Sec. 26-161. Vehicles Left Unattended.
Any vehicle left unattended on a street, alley, or
city owned property within the city for more than
forty-eight (48) hours may, at the direction of a law
enforcement official, be removed and impounded.
Provided, however, that a law enforcement official shall
conspicuously post upon the vehicle, at least forty-eight
(48) hours prior to impoundment, a notice stating the
intention to impound and the date and time after which
impoundment will occur. Unlicensed or inoperable
vehicles shall be removed from the street, alley, or city
owned. property whether attended or.not.
SECTION 4. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invali.d
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
SECTION 5. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
---Ca-pe- G-i-rardeau, --M-is-sour, a-nd the - sections -- of -- this- Code -may be - -
renumbered to accomplish such intention.
SECTION 6. This ordinance shall be in full force and effect
ten days after its passage and approval.
