AN ORDINANCE ACCEPTING SEWER EASEMENTS IN CAPE LA
CROIX PHASE III TRUNK SEWER PROJECT FROM LEO E.
BOREN AND VIRGINIA M. BOREN; JERRY W. FORD; FIRST
ASSEMBLY OF GOD CHURCH, INC.; NORMAN HUHN AND
WILMA L. HUHN; BOBBY G. CLARK AND JANE K. CLARK;
SEVENTEEN -O -SEVEN OFFICE CENTRE LTD.; KATHERYN S.
WULFERS, VIRGINIA L. STEWART, JUANITA E. HAAS,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
_SECTION 1. The City of Cape Girardeau, Missouri, hereby
accepts the sewer easement executed by Leo E Boren and Virginia
M. Boren, husband and wife, conveying a sewer easement in the Cape
LaCroix Phase III Trunk Sewer Project to the City in the following
described real estate located in the City and County of Cape
Girardeau, Missouri:
Parcel No. 15-909-00-02-009
A permanent easement 15 feet in width to construct, maintain and
repair a sanitary sewer line, manholes and other appurtenances
being 7.5 feet on either side of the centerline hereinafter
described and a temporary construction easement 80 feet in width
to construct a sanitary sewer, manholes and other appurtenances,
30 feet of said 80 feet lying south of the centerline hereinafter
described and 50 feet of said 80 feet lying North of the
centerline hereinafter described across a tract of land conveyed
to Leo E. Boren and Virginia M. Boren, husband and wife, by deed
recorded in Book 285, Page 959 in the office of the Recorder of
Deeds of Cape Girardeau County, Missouri being part of the
Northwest Quarter of the Southwest Quarter of Section 26, Township
31 North, Range 13 East, said centerline being more particularly
described as follows: Beginning at a point on the East line of
aforesaid Boren tract, from which point the Southeast corner of
said tract bears South 420 52' 50" East a distance of 62.66 feet;
thence South 70° 09' 53" West along said centerline as surveyed a
distance of 61.42 feet; thence South 871 38' 54" West a distance
of 117 feet; thence South 80° 09' 54" West a distance of 89.86
feet to a point on the West line of said Boren tract, from which
point the Southwest corner of said Boren tract bears South 010 56'
54" West a distance of 4.50 feet, said point being the termination
of said easement.
SECTION 2. The City of Cape Girardeau, Missouri, hereby
accepts the sewer easement executed. by Jerry W. Ford, conveying a
sewer easement in the Cape LaCroix Phase III Trunk Sewer Project
to the City in the following described real estate located in the
City and County of Cape Girardeau, Missouri:
Parcel No. 15-909-00-01-003
A permanent easement 15 feet in width to construct, maintain and
repair a sanitary sewer line, manholes and other appurtenances
being 7.5 feet on either side of the centerline hereinafter
described and a temporary construction easement 85 feet in width
to construct, maintain and repair a sanitary sewer line, manholes
and other appurtenances, 30 feet of said 85 feet lying South of
the centerline hereinafter described and 55 feet of said 85 feet
lying North of the centerline hereinafter described up to and
including station 81+52 where the width of the temporary
construction easement remains 30 feet in width on the South side
of aforesaid centerline and becomes 50 feet in width on the North
side of aforesaid centerline across part of the East half of the
East half of the Southwest Quarter of Section 26, township 31
North, Range 13 East conveyed to Jerry W Ford by deed recorded in
Book 359, Page 819 in the office of the Recorder of Deeds of Cape
Girardeau County, Missouri, said centerline being more
particularly described as follows: Beginning at a point on the
West line of the East half of the East half of the Southwest
Quarter of aforesaid Section 26, from which point the Southwest
corner of the East Half of the Southeast Quarter of aforesaid
Southwest Quarter bears South 00° 16' 37" West a distance of
1173.83 feet; thence North 781 53' 52" West along said centerline
as surveyed a distance of 77.02 feet; thence North 790 50' 02"
West a distance of 370.00 feet; thence North 771 18' 33" West a
distance of 270 feet; thence North 75° 47' 57" West a distance of
5.36 feet to a point on the West line of the East half of
aforesaid Southwest Quarter, from which point the Northeast corner
of the Northwest Quarter of. the Southwest Quarter of aforesaid
Section 26 bears South 000 27' 08" a distance of 47.61 feet, said
point being the point of termination of said easement.
SECTION 3. The City of Cape Girardeau, Missouri, hereby
accepts the sewer easement executed by First Assembly of God
Church, Inc. of Cape Girardeau, Missouri, Its Trustees and Their
Successors, conveying a sewer easement in the Cape LaCroix Phase
III Trunk Sewer Project to the City in the following described
real estate located in the City and County of Cape Girardeau,
Missouri:
Parcel No. 15-914-00-04-016
A permanent easement to construct, maintain and repair a sanitary
sewer line, manholes and other appurtenances across that part of
Outlot 78B, U.S. Survey No. 2199, Township 31 North, Range 13 East
as conveyed to First Assembly of God Church, Inc. of Cape
Girardeau, Missouri, Its Trustees and Their Successors by deed

recorded in Book 236, Page 629 in the office of the Recorder of
Deeds of Cape Girardeau County, Missouri, said easement is more
particularly described as follows: Beginning at a point on the
North line of aforesaid tract, from which point the Northeast
corner of said tract bears North 83155149" East a distance of 5.53
feet; thence South 63000117" West a distance 28.49 feet; thence
South 89°38'49" West a distance of 102.17 feet to a point on
aforesaid North line; thence North 83055149" East a distance of
128.28 feet to the point of beginning.
ALSO a temporary easement to construct a sanitary sewer line,
manholes and other appurtenances across that part of Outlot 78B,
U.S. Survey No. 2199, Township 31 North, Range 13 East as conveyed
to First Assembly of God Church, Inc. of Cape Girardeau, Missouri,
Its Trustees and Their Successors, by deed recorded in Book 236,
Page 629 in the office of the Recorder of Deeds of Cape Girardeau
County, Missouri, said easement is more particularly described as
follows: Beginning at the Northeast corner of aforesaid tract;
thence South 05047153" West a distance of 48.21 feet; thence South
63000109" West 'a distance of 17.62 feet; thence South 89138'49"
West a distance of 380.29 feet; thence South 76058105" West a
distance of 22.94 feet to a point on the East line of Mount Auburn
Road; thence North 05054121" East along said East line a distance
of 18.78 feet; thence North 83055149" East a distance of 423.64
feet to the point of beginning.
SECTION 4. The City of Cape Girardeau, Missouri, hereby
accepts the sewer easement executed by Norman Huhn and Wilma L.
Huhn, husband and wife, conveying a sewer easement in the Cape
LaCroix Phase III Trunk Sewer Project to the City in the following
described real estate located in the City and County of Cape
Girardeau, Missouri:

A permanent easement 15 feet_ in width to construct, maintain and
repair a sanitary sewer line, manholes and other appurtenances
being 7.5 feet on either side of the centerline hereinafter
described and a temporary construction easement 100 feet in width
to construct, maintain and repair a sanitary sewer line, manholes
and other appurtenances, 50 feet of said 100 feet lying Southwest
of and at right angles to the centerline hereinafter described and
50 feet of said 100 feet lying Northeast of and at right angles to
the centerline hereinafter described across part of the East half
of the Northwest Quarter of Section 26, Township 31 North, Range
13 East, conveyed to Norman Huhn and Wilma L. Huhn, his wife, by
deed recorded in Book 445, Page 432 in the office of the Recorder
of Deeds of Cape Girardeau County, Missouri, said centerline being
more particularly described as follows: Beginning at a point on
the East line of said Huhn tract, from which point the most
Southern corner of said tract bears South 35100120" West a
distance of 506.19 feet; thence North 31°02104" West along the
centerline as surveyed for a distance of 169.33 feet to a point on
the West line of aforesaid Huhn tract, from which point the most

point of termination of said easement.
Also a permanent easement 15 feet in width to construct, maintain
and repair a sanitary sewer line, manholes and other appurtenances
being 7.5 feet on either side of the centerline hereinafter
described and a temporary construction easement 90 feet in width
to construct, maintain and repair a sanitary sewer line, manholes
and other appurtenances, 40 feet of said 90 feet lying Southwest
of and at right angles to the centerline hereinafter described and
50 feet of said 90 feet lying Northeast of and at right angles to
the centerline hereinafter described across part of the East half
of the Northwest Quarter of Section 26, Township 31 North, Range
13 East conveyed to Norman Huhn and Wilma L. Huhn, his wife, by
deed recorded in Book 445, Page 432 in the office of the Recorder
of Deeds of Cape Girardeau County, Missouri, said centerline being
more particularly described as follows: Beginning at a point on
the East line of said Huhn tract, from which point the most
Southern corner' of said tract bears South 35000120" West a
distance of 107.16 feet; thence North 61°17'5.8" West along the
centerline as surveyed for a distance of 101.23 feet to a point on
the West line of said Huhn tract, from which point the most
Western corner of said tract bears South 01003110" West a distance
of 116.49 feet, said point being the point of termination of said
easement.
A permanent easement 15 feet .in width to construct, maintain and
repair a sanitary sewer line, manholes and other appurtenances
being 7.5 feet on either side of the centerline hereinafter
described and a temporary construction easement 100 feet in width
to construct, maintain and repair a sanitary sewer line, manholes
and other appurtenances, 50 feet of said 100 feet lying Southwest
of and at right angles to the centerline hereinafter described and
50 feet of said 100 feet lying Northeast of and at right angles to
the centerline hereinafter described across part of the East half
of the Northwest Quarter of Section 26, Township 31 North, Range
13 East conveyed to Norman Huhn and Wilma L. Huhn, his wife, by
deed recorded in Book 403, Page 625 in the office of the Recorder
of Deeds of Cape Girardeau County, Missouri, said centerline being
more particularly described as follows: Beginning at a point on
the East line of said Huhn tract, from which point the most
Southern corner of said tract bears South 34149137" West a
distance of 390.17 feet; thence North 34009115" West along the
centerline as surveyed for a distance of 171.29 feet to a point on
the West line of aforesaid Huhn tract, from which point the most
Northern corner on the West line of said tract bears South
34149137" West a distance of 210.00 feet, said point being the
point of termination of said easement.
SECTION 5. The City of Cape Girardeau, Missouri, hereby
accepts the sewer easement executed by Bobby G. Clark and Jane K.
Clark, as tenants in common and not tenants by the entireties,
conveying a sewer easement in the Cape LaCroix Phase III Trunk

Sewer Project to the City in the following described real estate
located in the City and County of Cape Girardeau, Missouri:

A permanent easement 15 feet in width to construct, maintain and
repair a sanitary sewer line, manholes and other appurtenances
being 7.5 feet on either side of the centerline hereinafter
described and a temporary construction easement to construct,
maintain and repair a sanitary sewer line, manholes and other
appurtenances lying between the hereinafter described centerline
and the South line of the hereinafter described tract and a
temporary construction easement to construct, maintain and repair
a sanitary sewer line, manholes and other appurtenances, the North
line of said temporary construction easement is 30 feet Northeast
of and parallel with the hereinafter described centerline across
part of Southwest Quarter of the Northeast Quarter of Section 26,
Township 31 North, Range 13 East as conveyed to Bobby G. Clark and
Jane K. Clark, as tenants in common and not tenants by the
entireties, by deed recorded in Book 401, Page 750 in the office
of the Recorder _of Deeds of__Cape Girardeau county, Missouri, said
centerline is more particularly described as follows: Beginning
at a point on the Southeast line of aforesaid Clark tract, from
which point the most Southern corner of said tract bears South 360
00' 03" West a distance of 32.00 feet; thence North 540 23' 53"
West along the centerline as surveyed a distance of 135.68 feet to
a point on the Northwest line of aforesaid Clark tract, from which
point the most Western corner of said tract bears South 360 00'
02" West a distance of 18.14 feet, said point being the point of
termination of said easement.
SECTION 6. The City of Cape Girardeau, Missouri, hereby
accepts the sewer easement executed by Seventeen -O -Seven Office
Centre LTD., A Missouri Corporation, conveying a sewer easement in
the Cape LaCroix Phase III Trunk Sewer Project to the City in the
following described real estate located in the City and County of
Cape Girardeau, Missouri:

A permanent easement 15 feet in width to construct, maintain and
repair a sanitary sewer line, manholes and other appurtenances
being 7.5 feet on either side of the centerline hereinafter
described and a temporary construction easement to construct,
maintain and repair a sanitary sewer line, manholes and other
appurtenances lying between the hereinafter described centerline
and the South line of the hereinafter described tract and a
temporary construction easement to construct, maintain and repair
a sanitary sewer line, manholes and other appurtenances, the North
line of said temporary construction easement is described as
beginning at a point at the intersection of the South line of the
hereinafter described tract with a line which lies 60 feet
Northerly at right angles from and parallel with the back tangent
from Station 2+63 as surveyed and running straight to a point

which is 30 feet right of Station 3+34 as surveyed and then
running parallel with and 30 feet Northeasterly of the centerline
hereinafter described 224.8 feet to its intersection with the West
line of hereinafter described tract, said easement is across part
of the Southwest Quarter of the Northeast Quarter of Section 26,
Township 31 North, Range 13 East as conveyed to Gregory M.
Parrish, SVS Trust, Gregory M. Parrish, Trustee by deed recorded
in Book 440, Page 778 in the office of the Recorder of Deeds of
Cape Girardeau County, Missouri, said centerline is more
particularly described as follows: Beginning at a point on the
East line of said tract being station 4+77.53 and from which point
the most Western corner of said tract bears North 75150145" West a
distance of 87.51 feet; thence North 54123153" West along the
centerline as surveyed for a distance of 81.23 feet to a point on
the West line of aforesaid tract, from which point the most
Western corner of said tract bears South 36000103" West a distance
of 32.00 feet, said point being the termination of said easement.
SECTION 7. The City of Cape Girardeau, Missouri, hereby
accepts the sewer easement executed by Katheryn S. Wulf ers,
Virginia L. Stweart, Juanita E. Haas, Dale N. Stewart and LaWanda
Rose Kaiser, conveying a sewer easement in t e Cape LaCroix Phase
III Trunk Sewer Project to the City in the following described
real estate located in the City and County of Cape Girardeau,
Missouri:

A permanent easement 15 feet in width to construct, maintain and
repair a sanitary sewer line, manholes and other appurtenances
being 7.5 feet on either side of the centerline hereinafter
described and a temporary construction easement 80 feet in width
to construct a sanitary sewer, manholes and other appurtenances,
20 feet of said 80 feet lying North of the centerline hereinafter
described and 60 feet of said 80 feet lying south of the
centerline hereinafter described across a tract of land conveyed
to Katheryn S. Wulfers, Nelson Albert Stewart, Juanita E. Hass,
Dale N. Stewart and LaWanda Rose Kaiser, by Order of Complete
Settlement recorded in Book 410, Page 372 in the office of the
Recorder of Deeds of Cape Girardeau County, Missouri, being part
of Lot 6, Block One (1) and part of Lot 1, Block 2 of Timberlane
Subdivision as shown on the plat of same recorded in Plat Book 7
at Page 15 in the Cape Girardeau County land records, said
centerline is more particularly described as follows: Beginning
at a point in aforesaid Lot 6 on the East line of aforesaid tract,
from which point the Northeast corner of said tract bears North
08° 12' 00" East a distance of 23.12 feet; thence North 750 52'
17" West along the centerline as surveyed a distance of 103.39
feet; thence North 550 32' 56" West a distance of 94.39 feet to a
point on the West line of Timberlane Drive, from which point the
Northeast corner of Lot 4 of Block One (1) of aforesaid Timberlane
Subdivision bears North 251 18' 21" East a distance of 26.00 feet
and being the termination of said easement.
SECTION 8. The City of Cape Girardeau, Missouri, hereby
accepts the sewer easement executed by Nora E. Crosnoe, conveying
a sewer easement in the Cape LaCroix Phase III Trunk Sewer Project
to the City in the following described real estate located in the
City and County of Cape Girardeau, Missouri:

repair a sanitary sewer line, manholes and other appurtenances
being 7.5 feet on either side of the centerline hereinafter
described and a temporary construction easement 100 feet in width

and other appurtenances, 50 feet of said 100 feet lying southwest
of the centerline hereinafter described and 50 feet of said 100
feet lying Northeast of the centerline hereinafter described
across part of the East half of the Northwest Quarter of Section
26, Township 31 North, Range 13 East conveyed to Nora E. Crosnoe,
by deed recorded in Book 204, Page 239 in the office of the

distance of 193.88 feet to a point on the Northwest line of
aforesaid Crosnoe tract, from which point the most Western corner

feet, said point being the point of termination of said easement.
Also a permanent easement 15 feet in width to construct, maintain
and repair a sanitary sewer line, manholes and other appurtenances
being 7.5 feet on either side of the centerline hereinafter
described and a temporary construction easement 90 feet in width
to construct, maintain and repair a sanitary sewer line, manholes
and other appurtenances, 40 feet of said 90 feet lying Southwest
of the centerline hereinafter described and 50 feet of said 90
feet lying Northeast of the centerline hereinafter described
across part of the East half of the Northwest Quarter of Section
26, Township 31 North, Range 13 East, conveyed to Nora E. Crosnoe,
by deed recorded in Book 204, Page 239 in the office of the
Recorder of Deeds of Cape Girardeau County, Missouri, said
centerline being more particularly described as follows:
Beginning at station 16+86 on the centerline as surveyed; thence
North 701 51' 09" West along the centerline as surveyed a distance
of 143 feet; thence South 740 54' 17" West a distance of 54.60
feet to a point on the Northwest line of said Crosnoe tract, from
which point the most Western corner of said tract bears South 350
00' 20" West a distance of 255.38 feet, said point being the point
of termination of said easement.
SECTION 9. The City of Cape Girardeau, Missouri, hereby
accepts the sewer easement executed by Nora E. Crosnoe, Trustee

conveying a sewer easement in the Cape LaCroix Phase III Trunk
Sewer Project to the City in the following described real estate
located in the City and County of Cape Girardeau, Missouri:

repair a sanitary sewer line, manholes and other appurtenances
being 7.5 feet on either side of the centerline hereinafter
described and a temporary construction easement 100 feet in width

and other appurtenances, 50 feet of said 100 feet lying Southwest
of the centerline hereinafter described and 50 feet of said 100
feet lying Northeast of the centerline hereinafter described
across part of the East half of the Northwest Quarter of Section
26, Township 31 North, Range 13 East conveyed to Nora E. Crosnoe,
Trustee with Power of Sale Under Agreement dated January 23, 1980,
by deed recorded in Book 376, Page 419 in the office of the
Recorder of Deeds of Cape Girardeau County, Missouri, said
centerline being more particularly described as follows:
Beginning at a point on the Southeast line of said Crosnoe tract,
from which point the most Southern corner of said tract bears
South 27° 53' 06" West a distance of 424.70 feet; thence North 310
02' 04" West along the centerline as surveyed for a distance of
23.12 feet; thence North 311 02' 04" West a distance of 167.68
feet to a point on the Northwest line of aforesaid Crosnoe tract,
from which point the most Western corner of said tract bears South
350 00' 20" West a distance of 506.19 feet, said point being the
point of termination of said easement.
Also a permanent easement 15 feet in width to construct, maintain
and repair a sanitary sewer line, manholes and other appurtenances
being 7.5 feet on either side of the centerline hereinafter
described and a temporary construction easement 90 feet in width
to construct, maintain and repair a sanitary sewer line, manholes
and other appurtenances, 40 feet of said 90 feet lying Southeast
of the centerline hereinafter described and 50 feet of said 90
feet lying Northwest of the centerline hereinafter described
across part of the East half of the Northwest Quarter of Section
26, township 31 North, Range 13 East conveyed to Nora E. Crosnoe,
Trustee with Power of Sale under Agreement dated January 23, 1980,
by deed recorded in Book 376, Page 419 in the office of the
Recorder of Deeds of Cape Girardeau County, Missouri, said
centerline being more particularly described as follows:
Beginning at a point on the Southeast line of said Crosnoe tract,
from which point the most Southern corner of said tract bears
South 350 00' 20" West a distance of 255.38 feet; thence South 740
54' 17" West along the centerline as surveyed for a distance of
189.40 feet; thence North 61° 17' 58" West a distance of 52.64
feet to a point on the Northwest line of said Crosnoe tract, from
which point the most Western corner of said tract bears South 350
00' 20" West a distance of 107.16 feet, said point being the point
of termination of said easement.

SECTION 10. The City of Cape Girardeau, Missouri, hereby
accepts the sewer easement executed by August C. Heisler and
Catheline Heisler, conveying a sewer easement in the Cape LaCroix
Phase III Trunk Sewer Project to the City in the following
described real estate located in the City and County of Cape
Girardeau, Missouri:

A permanent easement 15 feet in width to construct, maintain and
repair a sanitary sewer line, manholes and other appurtenances
being 7.5 feet on either side of the centerline hereinafter
described and a temporary construction easement 125 feet in width
to construct a sanitary sewer, manholes and other appurtenances,
50 feet of said 125 feet lying Westerly of and parallel with the
centerline hereinafter described and 75 feet of said 125 feet
lying Easterly of and parallel with the centerline hereinafter
described to a point of intersection at Station 3+07 where on the
bisector of a deflection angle of 741 14' 30" the temporary
construction easement changes to a width of 110 feet, 40 feet of
said 110 feet lying_ Westerly of and parallel_ with the centerline
hereinafter described and 70 feet of said 110 feet lying Easterly
of and parallel with the centerline hereinafter described across a
tract of land conveyed to August C. Heisler and Delma A. Heisler,
husband and wife by deed recorded in book 149, Page 15 in the
office of the Recorder of Deeds of Cape Girardeau County,
Missouri, being part of Outlot No. 78A, U.S. Private Survey No.
2199, Township 31 North, Range 13 East, said centerline being more
particularly described as follows: Beginning at a point on the
South line of aforesaid Heisler tract, from which point the
Northeast corner of Lot 8 of Mount Auburn Subdivision as shown on
the plat of same on file in the office of the Recorder of Deeds of
Cape Girardeau County, Missouri bears North 88°46125" West a
distance of 268.44 feet; thence North 07°48'43" East along the
centerline as surveyed a distance of 174.78 feet; thence North
41033136" East a distance of- 132.00 feet to station 3+07; thence
North 32140'55" West a distance of 262.00 feet; thence North

line of State Highway No. 61 (Kingshighway), said point being the
point of termination of said easement, and from which point a
right-of-way marker 131 feet right of highway station 1004+27.3
bears North 54°12'08" West a distance of 39.21 feet.
ALSO a permanent easement 15 feet in width to construct, maintain
and repair a sanitary sewer line, manholes and other appurtenances
being 7.5 feet on either side of the centerline hereinafter
described and a temporary construction easement 120 feet in width,
being 60 feet on either side of the centerline hereinafter
described across a tract of land conveyed to August C. Heisler and
Delma A. Heisler, husband and wife by deed recorded in Book 149,
Page 15 in the office of the Recorder of Deeds of Cape Girardeau

14+62 on the centerline as surveyed; thence North 78039138" West a

Auburn Road and being the point of termination of said easement.

said easement being more particularly described as follows:
Beginning at the intersection of the south line of aforesaid
Heisler tract with the East line of Mount Auburn Road, from which
point the Northeast corner of Lot 8 of Mount Auburn Subdivision as
shown on the plat of same on file in the office of the Recorder of
Deeds of Cape Girardeau County, Missouri bears North 88146'25"
West a distance of 70.62 feet; thence North 06022_126" East along
said East line a distance of 47.21 feet thence South 84153'04"
East a distance of 146.72 feet; thence South 07048143" West a
distance of 30.97 feet to a point on aforesaid South line of said
Heisler tract; thence North 88046125" West a distance of 147.20
feet to the point of beginning.

the office of the Recorder of Deeds of Cape Girardeau County,
Missouri being part of East half of the Southeast Fractional
Quarter of Section 26, T. 31 N., R. 13 E., said centerline being
more particularly described as follows: Beginning at the
Northeast corner of Lot 8 of Mount Auburn Subdivision as shown on
the plat of same on file in the office of the Recorder of Deeds of
Cape Girardeau County, Missouri; thence South 880 46' 26" West
along the North of said Lot 8 a distance of 487.2 feet to the
Northwest corner of a tract of land conveyed to the City of Cape
Girardeau, Missouri, by deed recorded in Book 442, Page 891 in the
office of the Recorder of Deeds of Cape Girardeau County,
Missouri, said point being the termination of said easement.
Also a permanent easement 15 feet in width to construct, maintain
and repair a sanitary sewer line, manholes and other appurtenances
being 7.5 feet on either side of the centerline hereinafter
described and a temporary construction easement 85 feet in width

30 feet of said 85 feet lying South of the centerline hereinafter
described and 55 feet of said 85 feet lying North of the
centerline hereinafter described across a tract of land conveyed

of _Deeds of Cape Girardeau County, Missouri being part of the East
half of the Southeast Fractional Quarter of Section 26, T. 31 N.,
R. 13 E., said centerline being more particularly described as
follows: Beginning at the Northwest corner of a tract of land
conveyed to the City of Cape Girardeau, Missouri, by deed recorded
in Book 442, Page 891 in the office of the Recorder of Deeds of
Cape Girardeau County, Missouri; thence South 880 46' 26" West
along said centerline as surveyed a distance of 191 feet; thence
North 780 53' 52" West a distance of 492.98 feet to a point on the
West line of the East half of the East half of the Southwest
Quarter of aforesaid Section 26, said point being the point of
termination of said easement, from which point the Southwest
corner of the East Half of the Southeast Quarter of the Southwest
Quarter of aforesaid Section 26 bears South 000 16' 37' West a
distance_ of 1173.83 _feet •
SECTION 11. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
SECTION 12. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.
SECTION 13. This ordinance shall be in full force and effect
ten days after its passage and approval.
