AN ORDINANCE ACCEPTING TWO EASEMENTS FROM
MIDAMERICA HOTELS CORPORATION FOR SEWER
CONSTRUCTION AT THE STATE HIGHWAY NO. 61 AND
INTERSTATE HIGHWAY NO. I-55 NORTH INTERCHANGE
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. The City of Cape Girardeau, Missouri, hereby
accepts an Easement executed by Midamerica Hotels Corporation, a
Missouri Corporation, Successor by merger dated December 26, 1986,
to Victorian Inns, Inc., conveying to the City of Cape Girardeau,
Missouri, an Easement for sewer construction at the State Highway
No. 61 and Interstate Highway No. I-55 North interchange, more
particularly described as follows, -to-wit: -
A permanent easement to construct, maintain and repair a
sanitary sewer line, manholes and other appurtenances, said
easement being part of a tract of land conveyed to
Victorian Inns, Inc. by deed recorded in Book 411, Page 455
in the office of the Recorder of Deeds of Cape Girardeau
County, Missouri, and being part of the Southwest Quarter
of the Northwest Quarter and part of the Northwest Quarter
of the Southwest Quarter of Section 22, Township 31 North,
Range 13 East in the City of Cape Girardeau, Missouri, said
easement being more particularly described as follows:
Beginning at the Northeast or most Eastern corner of
aforesaid tract; thence South 310 35' 27" West a distance
of 4.5 feet; thence North 580 12' 37" West a distance of
909.01 feet; thence North 240 16' 24" East a distance of
4.6 feet to a point on the North line of aforesaid tract
and also being the South right-of-way line of State Highway
No. 61; thence South 580 12' 37" East along said line a
distance of 909.60 feet to the point of beginning.
Also a temporary easement to construct, maintain and repair
a sanitary sewer line, manholes and other appurtenances,
said easement being part of a tract of land conveyed to
Victorian Inns, Inc. by deed recorded in Book 411, Page 455
in the office of the Recorder of Deeds of Cape Girardeau
County, Missouri, and being part of the Southwest Quarter
of the Northwest Quarter and part of the Northwest Quarter
of the southwest Quarter of Section 22, Township 31 North,
Range 13 East in the City of Cape Girardeau, Missouri, said
easement being more particularly described as follows:
Beginning at the Northeast or most Eastern corner of
aforesaid tract; thence South 310 35' 27" West a distance
of 45 feet; thence North 580 12' 37" West a distance of
885.54 feet to a point on the West line of aforesaid tract
and also being the East right-of-way line of Interstate
Highway No. 55; thence North 100 48' 20" West along said
East line a distance of 61.26 feet to a right-of-way marker
at the Northwest or most Northern corner of aforesaid tract
of land, said right-of-way marker also being the
intersection of aforesaid East right-of-way line with the
South right-of-way line of State Highway No. 61; thence
South 580 12' 37" East along said South right-of-way line a
distance of 926.85 feet to the point of beginning.
SECTION 2. The City of Cape Girardeau, Missouri, hereby
accepts an Easement executed by Midamerica Hotels Corporation,
a Missouri Corporation, Successor by merger dated December 26,
1986, to Victorian Inns, Inc., conveying to the City of Cape
Girardeau, Missouri, an Easement for sewer construction at the
State Highway No. 61 and I-55 North interchange, more
particularly described as follows, to -wit:
A permanent easement 10 feet in width to construct,
maintain and repair a sanitary sewer line, manholes and
other appurtenances, being 5 feet on either side of the
centerline across a tract of land being part of the
Fractional Southwest Quarter of Fractional Section 15, part
of the Fractional Southeast Quarter of Fractional Section
16, part of the Northeast Quarter of the Northeast Quarter
of Section 21 and part of the West Half of the Northwest
Quarter of Section 22, all in Township 31 North, Range 13
East as conveyed to Victorian Inns, Inc., a Missouri
Corporation, by deed recorded in Book 407, Page 271 in the
office of the Recorder of Deeds of Cape Girardeau,
Missouri, said centerline being more particularly described
as follows: Beginning at a point on the North right-of-way
line of State Highway No. 61, from which point a point at
the intersection of said North right-of-way line with the
East right-of-way line of Interstate Highway No. 55, said
point being 355 feet left of Interstate Highway No. 55
Stateion 1025+75, bears North 540 47' 28" West a distance
of 364.89 feet; thence North 240 16' 25" East, a distance
of 19.72 feet; thence North 540 27' 23" West a distance of
351.24 feet; thence North 300 15' 45" West a distance of
327.29 feet to the point of ending and said easement
extends North 300 15' 45" West a distance of 5 feet from
said point of ending.
Also a temporary easement to construct, maintain and repair
a sanitary sewer line, manholes and other appurtenances,
said easement being part of the Fractional Southwest
Quarter of- Fractional Section 15, part of the Fractional
Southeast Quarter of Fractional Section 16, part of the
Northeast Quarter of the Northeast Quarter of Section 21
and part of the West Half of the Northwest Quarter of
Section 22, all in Township 31 North, Range 13 East as
conveyed to Victorian Inns, Inc., a Missouri Corporation,
by deed recorded in Book 407, Page 271 in the office of the
Recorder of Deeds of Cape Girardeau, Missouri, said
easement being more particularly described as follows:
Beginning at the intersection of the North right-of-way
line of State Highway No. 61 with the East right-of-way
line of Interstate Highway No. 55, said point being 355
feet left of Interstate Highway No. 55 Station 1025+75;
thence North 321 04' 35" West a distance of 352.34 feet;
thence North 59° 44' 45" East a distance of 109.80 feet;
thence South 300 15' 45" East a distance of 336.21 feet;
thence South 54° 27' 23" East a distance of 396.69 feet;
thence South 241 16' 25" West a distance of 95.74 feet to a
point on aforesaid North right-of-way line; thence North
540 47' 28" West a distance of 441.28 feet to the point of
beginning.
SECTION 3. This ordinance shall be in full force and effect
ten days after its passage and approval
