AN ORDINANCE ACCEPTING A PERMANENT CONSTRUCTION
EASEMENT FROM HOWARD C. TOOKE AND FRANCES H.
TOOKE FOR CONSTRUCTION AT THE INTERSECTION OF ELM
AND FOUNTAIN STREETS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION 1. The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Construction Easement executed by Howard C.
Tooke and Frances H. Tooke, conveying to the City of Cape
Girardeau, Missouri, an easement for construction at the
intersection of Elm and Fountain Streets, more particularly
described as follows, to -wit:
A tract of land in Out Lot 47, U. S. Private Survey No.
2199, Township 30 North, Range 14 East, in the City of
Cape Girardeau, Missouri, more particularly described as
follows:
Beginning at the Southeast corner of Lot 15, Block 7,
Giboney Houck's 2nd Subdivision; thence in a Westerly
direction along the North right-of-way line of Elm
Street, 7 feet; thence in a Northeasterly direction 9.8
feet to a point on the West right-of-way line of Fountain
Street; thence in a Southerly direction 7 feet to the
point of beginning.
SECTION 2. This ordinance shall be in full force and effect
ten days after its passage and approval.
