AN ORDINANCE ACCEPTING A QUIT CLAIM DEED FROM THE
MISSOURI HIGHWAY AND TRANSPORTATION COMMISSION
FOR INDEPENDENCE STREET RIGHT-OF-WAY
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION 1. The City of Cape Girardeau, Missouri, hereby
accepts a Quit Claim Deed executed by the Missouri Highway and
Transportation Commission, conveying to the City of Cape
Girardeau, Missouri, certain Independence Street right-of-way,
more particularly described as follows, to -wit:
All rights, title and interest in and to a portion of the
existing right-of-way of present State Route 34 acquired
from Centerre Bank of Cape Girardeau, N.A. by deed
conveyance dated October 14, 1986, as recorded in Book
457, Page 127, in the Recorder's Office of Cape Girardeau
County, Missouri, described as follows:
A tract of land being a part of U.S.P. Survey No. 2199,
T. 30 N., R. 13 E., in the City and County of Cape
Girardeau, State of Missouri described as lying South of
and adjoining Independence Street is designated by widths
as measured at right angles from the herein described
Independence Street centerline as follows: Commencing at
the common corner of Out Lots 57, 58, 81 and 87, U.S.P.
Survey No. 2199, T. 30 N., R. 13 E., thence N. 830 44' W.
664.22 feet to Station 1122+38.6 on the highway
centerline of State Route 34, established by Job No.
10-U-34-338; thence N. 11° 00' E. 169.5 feet along said
State Route 34 highway centerline to P.T. Equation Sta.
1120+69.1 Bk. equals Sta. 1120+65.7 Ahd.; thence
continuing along said Route 34 highway centerline being
the arc of a 11 53' curve to the left having a radius of
3,042.39 ft. and an interior angle of 91 15' a distance
of 491.5 ft. to Route 34 Sta. 1115+74.2 equals
Independence Street centerline Sta. 10+00.0; thence from
a tangent to curve bearing of N. 11 44' 49" E. measure N.
83° 39' 04" W. along the centerline of Independence
Street 345.6 ft. to Sta 13+45.4; thence S. 60 20' 56" W.
35.0 ft. to the South limits of Independence Street for
the POINT OF BEGINNING of tract to be conveyed; thence S.
830 39' 04' E. 134.8 ft. to a point 35 ft, opposite Sta.
12+10.8; thence S. 60 20' 56" W. 8.7 ft. to a point 43.7
ft. opposite Sta. 12+10.8; thence N. 810 16' 33" W. 89.3
ft. to a point 40 ft. opposite Sta. 13+00; thence N. 830
39' 04" W. 45.4 ft. to a point 40 ft. opposite Sta.
13+45.4; thence N. 50 12' 11" E. 5.0 ft. to the point of
beginning containing 0.02 of an acre.
Subject to all easements of record and all public utility
facilities as now located.
SECTION 2. This ordinance shall be in full force and effect
ten days after its passage and approval.
