AN ORDINANCE CALLING A SPECIAL ELECTION IN THE
CITY OF CAPE GIRARDEAU, MISSOURI, ON THE QUESTION
WHETHER THE CITY SHALL ANNEX A PORTION OF
INTERSTATE HIGHWAY 55 RIGHT-OF-WAY LOCATED IN
CAPE GIRARDEAU AND SCOTT COUNTY, MISSOURI,
DESIGNATING THE TIME OF HOLDING THE ELECTION;
AUTHORIZING AND DIRECTING THE CITY CLERK TO GIVE
NOTICE OF THE ELECTION; AND DECLARING AN
EMERGENCY TO EXIST
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION 1. A special election is hereby ordered to be held in
the City of Cape Girardeau, Missouri, on Tuesday, August 8, 1989,
on the following question:
QUESTION
Shall the municipality of Cape Girardeau, Missouri, annex
a portion of Interstate Highway 55 right-of-way located
in Cape Girardeau County and Scott County, Missouri, as
authorized by a judgment of the Circuit Court of Cape
Girardeau County, Missouri, entered March 9, 1989, and a
judgment of the Circuit Court of Scott County, Missouri,
entered May 9, 1989?
This land which is proposed for annexation is adjacent to
the western boundary of the City of Cape Girardeau and is
described as all of the Interstate Highway 55
right-of-way located in Cape Girardeau County between the
southern boundary of Cape Girardeau County and a point
located approximately 2,000 feet north of the
intersection of Highway 61 and Interstate Highway 55 and
the west one-half of the Interstate Highway 55
right-of-way located in Scott County between the northern
boundary of Scott County and a point located
approximately 8,400 feet south of the northern boundary
of Scott County.
SECTION 2. The form of the notice of election for the special
election, a copy of which is hereby attached and made a part
hereof, is hereby approved.
SECTION 3. The City Clerk is hereby authorized and directed
to notify the County Clerk of Cape Girardeau County, Missouri, of
the passage of this ordinance no later than 5:00 o'clock P.M. on
June 13, 1989, and to include in the notification all of the terms
and provisions required by the Comprehensive Election Act, Chapter
115, Missouri Revised Statutes, 1978, as amended.
SECTION 4. It is hereby found and declared that an emergency
exists as provided for in Section 3.15 of the City Charter of the
City of Cape Girardeau, Missouri, in that the election authority,
under the time of notice provision set forth in Section 115.125,
Missouri Revised Statutes, 1978, as amended, must be notified not
later than 5:00 o'clock P.M. on June 13, 1989, of an election to
be held on August 8, 1989. It is hereby further found and
declared that calling an election and providing for the submission
of a proposal to the people is an emergency measure as provided in
Section 3.15(d) of the City Charter of the City of Cape Girardeau,
Missouri.
SECTION 5. This ordinance shall be in full force and effect
from and after its passage and approval.

CITY OF CAPE GIRARDEAU, MISSOURI
Notice is hereby given to the qualified voters of the City of
Cape Girardeau, Missouri, that the City Council of the City has
called a special election to be held in the City on August 8,
1989, commencing at 6:00 o'clock A.M. and closing at 7:00 o'clock
P.M. on the question contained in the following sample ballot:

QUESTION
Shall the municipality of Cape Girardeau, Missouri, annex
a portion of Interstate Highway 55 right-of-way located
in Cape Girardeau County and Scott County, Missouri, as
authorized by a judgment of the Circuit Court of Cape
Girardeau County, Missouri, entered March 9, 1989, and a
judgment of the Circuit Court of Scott County, Missouri,
entered May 9, 1989?
